HomeMy WebLinkAboutCity Council - 3252 RESOLUTION NO. 3252 RESOLUTION DETERMINING FEASIBILITY OF PROJECT, WAIVING DEBT LIMITATION, AND OVERRULING PROTESTS ASSESSMENT DISTRICT NO. 6602 HUNTINGTON BEACH, CALIFORNIA WHEREAS, a public hearing was duly and legally called and held by the City Council of the City of Huntington Beach, California upon the Investigation Report of DONALD E . STEVENS, INC. , Engineer of Work, Assessment District No . 6602 , City of Huntington Beach, County of Orange , State of California, on December 7 , 1970 , at which time said report was first summarized; and WHEREAS, all protests made in writing or orally to said proposed acquisition and improvement were duly and legally considered; and WHEREAS, said Engineer of Work has advised that said protests , both oral and written, were not made by owners of more than half of the area of the property pro- posed to be assessed for said proposed acquisition, work and improvement , and said City Council having acquired jurisdiction to proceed herein: NOW, THEREFORE , BE IT RESOLVED by the City Council of the City of Huntington Beach, State of California, -1- in regular session assembled, that all of said protests , both oral and in writing, be and the same hereby are over- ruled and denied. BE IT FURTHER RESOLVED that said City Council hereby finds from said Investigation Report, the informa- tion and opinion furnished by said Engineer of Work, and its personal knowledge of the land and improvements in this assessment district, that said proposed project is feasible, that the public interest, convenience and necessity require said proposed acquisition, work and improvement, and that the lands to be assessed will be able to carry the burden of the proposed assessments. BE IT FURTHER RESOLVED that the limitations upon the amount of assessments provided for in the Special Assess- ment Investigation, Limitation and Majority Protest Act of 1931 , Division 4 of the Streets and Highways Code of the State of California, shall be disregarded, both with respect to the limitations on the district as a whole and as to the limitations on individual specific assessments . BE IT FURTHER RESOLVED that proceedings for said improvement shall be taken under the Improvement Act of 1911 of the State of California, Division 7 of the Streets and Highways Code, and improvement bonds shall be issued pursuant -2- to the provisions of said Improvement Act.
