HomeMy WebLinkAboutCity Council - 3257 RESOLUTION NO. 3257 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ESTABLISHING THE HUNTINGTON BEACH ENVIRONMENTAL COUNCIL WHEREAS, there is a grave environmental and pollution problem facing the nation today, and the City Council of the City of Hunting- ton Beach desires to take vigorous measures toward controlling such problem, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach as follows : SECTION 1 . ENVIRONMENTAL COUNCIL. There is hereby created for the City of Huntington Beach the Huntington Beach Environmental Council hereinafter referred to as the "Environmental Council . " SECTION 2 . COMPOSITION AND APPOINTMENT OF MEMBERS . COMPEN- SATION. The Environmental Council shall consist of not to exceed twenty-one (21) members all appointed by the City Council. All members shall be residents of the City of Huntington Beach and more than one-half of the members shall be registered voters of the City of Huntington Beach. All members shall serve without compensation and none shall hold any office or employment in the city government . ''All members shall serve a term of four years except as provided in Section 3 of this resolution and until their successors are appointed and qualified. If vacancies shall occur otherwise than by expiration of terms, they shall be filled by appointment for the unexpired portion of the terms . SECTION 3 . FIRST ENVIRONMENTAL COUNCIL. The first Environmental Council to be appointed shall, at its first meeting, so classify its members by lot, that one-fourth of its members shall serve for one (1) year terms, one-fourth for two (2) year terms , one-fourth for three (3) year terms and one-fourth for four ( 4) year terms . -l- SECTION 4 . CHAIRMAN. The City Council shall appoint a chairman for the Environmental Council who shall serve a term of two (2) years and until his successor is appointed and qualified . If a vacancy in the office of chairman shall occur otherwise than by expiration of term, it shall be filled by appointment for the unexpired portion of the term. SECTION 5 . REMOVAL OF MEMBERS . Any member of the Environ- mental Council, including the chairman, shall be subject to removal by motion of the City Council adopted by at least four (4) affirma- tive votes . The membership of any member of the Environmental Council shall be vacated if such member absents himself from three (3) regular meetings of the Environmental Council, unless by per- mission of such Environmental Council, or ceases to continue to comply with the requirements of new members as to residence and/or voter registration. SECTION 6 . BYLAWS . The Environmental Council may adopt by- laws and rules , as it deems necessary for the selection of its officers, other than chairman, the time and place of its meetings , and such other matters relative to its work and administration of its duties which are not otherwise provided for by this resolution. SECTION 7 . ADVISERS AND ASSISTANTS TO THE ENVIRONMENTAL COUNCIL. The Environmental Council may request the city staff to provide to it information and, subject to approval of the City Administrator, such assistance as may be helpful and desirable to effectuate the purposes of the Environmental Council. The Environ- mental Council may have as many ex officio members , without the power to vote, as may be appointed by the City Council. The Environ- mental Council may make investigations and employ persons , subject to the approval of the City Council as it may deem necessary to perform its duties and functions . -2- SECTION 8. POWERS AND DUTIES GENERALLY. The Environmental Council shall be empowered and have the duty to : (a) Study the environment of the City of Huntington Beach and investigate all actual and any potential threats to continued maintenance of a clean environment for the city and its inhabi- tants; and (b ) Report to the City Council, to other city boards , com- missions, departments, and to other public and private agencies and groups its recommendations for affirmative steps that may be taken to maintain and improve the quality of the environment of the City of Huntington Beach for its inhabitants ; and (c ) Report to the City Council, to other city boards , com- missions, departments and to other public and private agencies and groups its recommendations for legislation and other action that could or might curtail or limit those activities which appear to be an actual present threat, or which may become a potential threat in the future, for the maintenance of a clean environment for the city and its inhabitants; and (d) To perform such other duties as may, from time to time, be properly assigned or delegated to it by the City Council.
