HomeMy WebLinkAboutCity Council - 3283 RESOLUTION OF INTENTION NO . 3283 ASSESSMENT DISTRICT NO. 6602 HUNTINCTON BEACH, CALIFORNIA The City Council of the City of Huntington Beach, California, in regular session assembled, does hereby resolve and determine as follows: SECTION 1: The public interest and convenience require, and it is the intention of said City Council to order the following acquisition of permanent easements and rights of way for street and utility purposes , and the following work to be done, and improvements to be made, in said City of Huntington Beach, California, to wit: The acquisition of the following described permanent street and public utility easements and rights of way, all of which will henceforth be referred to in this assessment district proceeding by the name of the public street or public alley to which each becomes a part: That portion of lot 4 and lot 6 , Block J, Tract 349 , as recorded in Book 15 , page 17 of Miscellaneous Maps, Records of Orange County, California, included in the below described Parcel: The East 30 . 00 feet of lot 2 , block 17 , Tract 86 as recorded in Book 10 , pages 35 and 36 of Miscellaneous Maps, Records of Orange County, California. The West 10 . 00 feet of lot 4 and lot 6 , block J Tract 349 as shown on a map recorded in Book 15 , page 17 of Miscellaneous Maps Records of Orange County, California. -1- That portion of Lot 11, Block J, Tract 349 , as recorded in Book 15 , page 17 of Miscellaneous Maps, Records of Orange County, California, included in the below described Parcel: The West 30 . 00 feet of lot 2 , block 17 , Tract 86 as recorded in Book 10 , pages 35 and 36 of Miscellaneous Maps , Records of Orange County, California. The East 10 . 00 feet of Lot 11, Block J, Tract 349 as shown on a map recorded in Book 15 , page 17 of Miscellaneous Maps Records of Orange County, California. That portion of Lot 18 , Block J, Tract 349 , as recorded in Book 15 , page 17 of Miscellaneous Maps , Records of Orange County, California, included in the below described parcel: The East 30 . 00 feet of lot 2 , Block 17 , Tract 86 as recorded in Book 10 , pages 35 and 36 of Miscellaneous Maps , Records of Orange County, California. The West 10. 00 feet of Lot 18 , Block J, Tract 349 as shown on a map recorded in Book 15 , page 17 of Miscellaneous Maps Records of Orange County, California That portion of Lot 11, Block M, Tract 475 , as recorded in Book 17 , page 19 of Miscellaneous Maps , Records of Orange County, California, included in the below described parcel: The West 30 . 00 feet of Lot 4 , Block 17 , Tract 86 as recorded in Book 10 , pages 35 and 36 of Miscellaneous Maps , Records of Orange County, California. The construction and installation of the following described work and improvements in the following described locations, including the removal of all existing pavement, curb and gutter, sidewalks and driveways that are obstacles in the line of said -2- work, and appurtenances and appurtenant work: A. Concrete curb and gutter, concrete cross gutters, concrete sidewalks , asphalt concrete pavement over aggregate base material: (1) in the Southeasterly .half .of Warner Avenue from a point 1200 feet Southwesterly of its intersection with the center line of Sims Street, measured parallel with the center line of Warner Avenue to its intersection with said center line of Sims Street. (2) in Sandra Lee Street from Warner Avenue to the existing pavement at a point in Sandra Lee Street 152 feet South of its intersection with the center line of Orion Street with the existing improvements to remain in place in the Westerly half of Sandra Lee_ Street_ from a point 302 , feet North of said center line of Orion Street to a point 152 feet South of said center line; also in the Easterly half of Sandra Lee Street for 60 feet between the Westerly prolongation of the North and South boundary lines of Lot 5 , Tract 475 , as shown by map on file in Book 17 , Page 19 of Miscellaneous Maps, Records of Orange County, California. ( 3) in the Westerly half of Sims Street from Warner. Avenue .to Los Patos Drive. (4) in the Northerly half of Los Patos Drive from Sims Street to a point 280 feet West of the center line of Sims Street. ( 5) in Orion Street from Sims Street to Sandra Lee Street. -3- B. An eight inch diameter vitrified clay pipe sewer main, with four inch diameter vitrified clay pipe sewer laterals, manholes, trenching and backfilling-, in Sims Street from a manhole to be constructed in the existing sewer main in its intersection with Warner Avenue to a manhole to be constructed in its intersection with Los Patos Drive. C. An eight inch diameter asbestos cement domestic water main, with three-quarter inch diameter copper water services , gate valves , and fire hydrants , in Sims Street from an existing water main in its intersection with Warner Avenue to its intersection with Los Patos Drive, and thence in Los Patos Drive to an existing water main in its intersection with Sandra Lee Street. D. Four inch diameter vitrified . clay pipe sewer laterals from an existing sewer main in Sandra Lee Street, and three-quarter inch diameter copper water services from an existing water main in Sandra Lee Street to serve Lots 5, 17 and 19 of said Tract No . 475 , and Lots 1, 3 , 5 , 7 , 9 , 11, 13, and 15 of Tract No. 349, as shown by map on file in Book 15 , Page 17 of Miscellaneous Maps, Records of Orange County, California. E. Concrete driveway approaches to serve Lots 12 , 14 , 16 , and 20 of said Tract No. 475 . F. Storm drain facilities , consisting of: (1) a concrete catchbasin and an eighteen inch diameter storm drain -in Warner Avenue from a point therein 70 feet Westerly of the center line of Sims Street to a point -4- therein 1210 feet Westerly of said center line. ( 2 ) a catchbasin to be .constructed in the Northerly terminus ofSandra Lee Street , and an eighteen inch diameter storm drain connection between. said_ catchbasin and the storm drain to be constructed in Warner _Avenue as aforesaid, said connection being at_ a point 92 -feet Easterly of the inter- section of Warner Avenue with the center line of Sandra Lee Street. G. Asphalt concrete pavement over aggregate base material, a concrete alley approach, and a concrete alley gutter, in the alley to be constructed between Warner Avenue and Orion Street at the rear of the Lots in said Tract No. 349 . SECTION 2 : All of the above mentioned work, including the grade to which said work shall be done and the location thereof in and upon the streets and rights of way above mentioned, shall be done upon the grades, along the lines, between the points, of the dimensions , at the places and in the matter described and set forth in the plans , profiles and detailed drawings of said work, and to specifications for said work heretofore adopted by said City Council on February 1 , 1971 by its Resolution No. 3282, which plans , profiles , detailed drawings and specifications are on file in the office of the City Engineer of said City of Huntington Beach, and which are hereby referred to for a more particular description of said work, grade of said work, and location of said work in and along the streets and rights of way hereinbefore mentioned, and to which plans , profiles, detailed -5- drawings and specifications reference is hereby made . SECTION 3: That said contemplated acquisition, work and improvements , in the opinion of said City Council, is of more than local or ordinary public benefit, and that the expenses and cost of said acquisition, work and improvements shall be charge- able upon a district, which said district said City Council hereby declares to be the district benefited by the acquisition, work and improvements herein described and to be assessed to pay the cost and expenses thereof. Said district shall include that territory in said City of Huntington Beach which is shown upon that certain plat or map thereof on file in the office of the City Clerk, en- titled "PROPOSED BOUNDARIES OF SANDRA LEE - SIMS ASSESSMENT DISTRICT, ASSESSMENT DISTRICT NO. 6602 , CITY OF HUNTINGTON BEACH, COUNTY OF ORANGE , STATE OF CALIFORNIA, " and which said map or plat indicates by a boundary line the extent of the territory included in the proposed district, and covers all details as to the extent of the area to be assessed. Reference is hereby made to said map. SECTION 4 : NOTICE IS HEREBY GIVEN that serial bonds shall be issued in the manner and form provided in Part 5 , Division 7 of the Streets and Highways Code of the State of California, the Improvement_Act of 1911, to represent unpaid assessments of Fifty Dollars ($50 . 00 ) or over, which said bonds shall bear interest at the rate of seven percent ( 70) per annum and the last installment of which bonds shall mature nine ( 9 ) years from the second day of January next succeeding the first day of September following their date. -6- SECTION 5 : NOTICE IS HEREBY FURTHER GIVEN that on Monday, the lst day of March, 1971 at the hour of 7 : 30 o' clock P.M. of said day, or as soon thereafter as the hearing hereinafter mentioned can be held, in the Council Chambers in the City Hall in said City of Huntington Beach, the meeting place of said City Council, any and all persons having any objections to the proposed acquisition, work and improvements , or any objections to the grades to which said work is to be done, or any objections to the boundaries of the district proposed to be assessed to pay the cost and expenses of said acquisition .work and improvements may appear before said City Council and show cause why said proposed acquisition 'work and improve- ments should not be carried out in accordance with this resolution of intention, and may present written protests in the form and manner required by law not later than the hour hereinabove set for hearing objections against authorizing said acquisition or the doing of said work, the grades to which said work is to be done, or the extent of the territory to be assessed to pay the cost and expenses of said acquisition, work and improvements. SECTION 6 : The City Clerk shall cause this resolution of intention to be published twice in the Huntington Beach News , a newspaper of general circulation, published and circulated in said City of Huntington Beach, which said newspaper has heretofore been designated by said City Council as the newspaper in which shall be printed and published all notices , resolutions, orders and other matters required to be published in the proceedings to be taken pursuant to this resolution and under the provisions of the Improve- ment Act of 1911. The first publication of said notice shall be not -7- less than ten (10) days prior to the date herein fixed for the public hearing under this resolution of intention. SECTION_ 7: The Superintendent of Streets of said City of Huntington. Beach shall cause to be conspicuously posted along the line of said contemplated_work and improvements, and on all the open streets within the assessment district notice of the passage of this resolution of intention, in the time, form and manner required by law. SECTION 8 : The City Clerk of said City of Huntington Beach is hereby directed_ to mail notices of the adoption of this resolution of intention, postage prepaid, to all persons owning real property proposed to be assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll for real property taxes , or as known to said clerk. Said mailing is to be completed at least fifteen (15) days prior to the day herein fixed for the public hearing under this resolution of intention, all in the time, form, and manner prescribed in said Improvement Act of 1911. SECTION 9 : NOTICE IS HEREBY FURTHER GIVEN that the grades to which said work is to be done are, or may be in part, new and different_from_those heretofore established, or may be, and in some cases are, different from existing ground levels. SECTION 10 : The total estimated cost of said acquisition work and improvements , including estimated incidental expenses , is in the amount of $181,096 . 50 . The City of Huntington Beach shall contribute to the cost of said proposed work and improvements, the actual cost of the work to be done in Warner Avenue , the Westerly -8- one-half of Sandra Lee Street from its intersection with Warner Avenue to a point in Sandra Lee Street 302 feet North of the center line of Orion Street, and fifty percent ( 500) of the actual cost of the construction of the domestic water system and the sanitary sewer system to be constructed in Sims Street and in Los Patos Drive, excepting therefrom the cost of construction of the water services and sewer laterals , in the estimated amount of *73 ,733 . 23 . SECTION 11: NOTICE IS HEREBY FURTHER GIVEN that the report of the Engineer of Work upon the proposed acquisition, work and improvements, as approved by said City Council, is on file in the office of the City Clerk of said City of Huntington Beach and open to public inspection. SECTION 12 : NOTICE IS HEREBY FURTHER GIVEN that said City Council has found that the storm drain pipe to be installed in this assessment district, made of either asbestos cement or fiber cement, is equal in quality, and that to secure the most favorable bid for the construction and installation of said storm drain pipe, alternate proposals specifying either type of storm drain pipe will be considered.
