HomeMy WebLinkAboutCity Council - 3340 RESOLUTION NO. 334o A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING AND IMPLEMENTING A MEMORANDUM OF AGREEMENT WITH THE HUNTINGTON BEACH POLICE OFFICERS ' ASSOCIATION The City Council of the City of Huntington Beach resolves as follows : The Memorandum of Agreement between the City of Huntington Beach and the Huntington Beach Police Officers ' Association dated July 26, 1971, a copy of which is marked Exhibit "A" and attached hereto and made a part hereof, is hereby approved and ratified and ordered implemented in accordance with the terms and conditions thereof. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at an adjourned regular meeting thereof held on the 26th day of July, 1971 . ayor ATTEST: City,,Zlerk APPROVED AS TO FORM: City Attorne // 33�a --� MEMORANDUM OF AGREEMENT Between THE CITY OF HUNTINGTON BEACH, CALIFORNIA Hereinafter called City , and THE HUNTINGTON BEACH POLICE OFFICERS ' ASSOCIATION Hereinafter called Association PREAMBLE This agreement has been reached and prepared after meeting and conferring in good faith between the City and _Association, pursuant to the provisions of Government Code Sections 3500 through 3511 and Resolution No. 3335 • ARTICLE I EDUCATION INCENTIVE PAY PLAN The Education Incentive Pay Plan dated July 1, 1971 , attached hereto as Exhibit 1, shall be effective July 1, 1971 . ARTICLE II Required uniforms shall be provided and replaced by the Police Department in accordance with procedures jointly developed. by Association and the Department . ARTICLE III Commencing, during the month of October 1971 , pay day shall be every other Friday. ARTICLE IV Upon a two week written notification to the Finance Director, each employee shall be entitled to receive his i earned ­va:cation pay , les-s- -deductions , in-advanc.e.,-..-pr_i,or. __t,o._ I � his regular scheduled annual vacation . Such advancements / limited to one during each employee ' s anniversary year . ARTICLE V An ad hoc committee shall be created to study the present Retirement System and shall prepare a written report with recommendations to the City Administrator and the Personnel Board_ at the earliest practical time . The Associ- ation shall appoint one member to such committee . ARTICLE VI Sick leave may be applied to an absence due to illness of the employee ' s spouse or child when the employee ' s presence is required at home , provided that such absence shall be limited to five ( 5) days per calendar year. ARTICLE VII Policemen assigned to duty as a helicopter pilot shall receive one hundred fifty ($150 ) dollars per month while so assigned. Policemen assigned to duty as a helicopter r observer shall receive seventy-five ($75 ) dollars per month 1 while so assigned . ARTICLE X _Employees shall be entitled to Bereavement Leave not to exceed three working days per calendar year in instance of / death in the immediate family . Immediate family is defined as father, mother, sister, brother, spouse or children of the employee . -2- ARTICLE XI r The "TEN-PLAN" shall be placed into effect for employees designated by the Chief of Police the first of the month following approval by the City Administrator. r ARTICLE XII TERM OF THE MEMORANDUM OF AGREEMENT ° This Memorandum of Agreement shall be in effect for a term commencing July 1, 1971, and ending June 30 , 1972 . ARTICLE XIII CITY COUNCIL APPROVAL It is the understanding of the City and Association that r this Memorandum of Agreement is of no force or effect whatso- ever unless or until ratified and approved by Resolution duly adopted by the City Council of the -City of Huntington Beach in accordance with Section 8 , Resolution No . 3335 • ARTICLE XIV "The association shall, within ten days following the execution of this agreement and its approval by the City Council , file with the Superior Court Clerk, County of Orange , a dis- missal with prejudice of that certain action pending in the Orange County Superior Court entitled, Huntington Beach Police Officers Association, Inc . , and Ron Pomeroy v . City of Huntington 'y '1 Beach, et al . , Case No . M-1628 , and a copy of such dismissal with t prejudice shall be served upon the office of the City Attorney . This agreement shall not be effective until such dismissal with prejudice is filed and entered in said action . Current Investigators retain 8 . 25% special assignment while so assigned, maximum of 36 months . See addendum 1 . 2 . Monthly amount increases/decreases based on Los Angeles-Long Beach Consumer Price Index . September 1 adjustment based on July all items figure . 3 . College major shall be Police Science, Criminology, Political Science, Sociology, Law, Business Administration, Public Administration, Psychology or closely similar field as approved by Chief of Police and Education Committee . 4 . Initial eligibility must be approved by Chief of Police . An acceptable yearly performance evaluation, signed by Chief of Police, is required. No inc-entive taken away without just cause . 5 . Training points approved by POST may be substituted for college units , on the following schedule : 10 of 30; 20 of 60; 30 of 90 . 6 . Pay to be effective first month following approval . 7 . After 120 units of B.A. POST approved training points may be substituted for college units without limit . 8 . Repeat college courses credited as determined by the college . 9 . Repeat POST approved seminars , institutes , etc . credited as - determined by the Chief of Police . 10 . All college units require grade of "C" or better to qualify . 11 . Obtaining transcripts or other acceptable documentation is employee responsibility . 12 . Employee may choose between POST training points or college units where a choice is available . No change allowed once choice is made, no double credit allowed. ADDENDUM 1 / All persons currently receiving the 8 . 25% special assignment (investigator) pay who do not immediately qualify at step III , or higher, of the Education Incentive Pay Plan, shall continue to draw the special assignment pay for a period up to 36 months under the following conditions : A. Must meet the continuing education requirements as set forth 1 EXHIBIT 1 above and` have a satisfactory annual performance evaluation. B. - Must remain in an investigative capacity . C . Upon attaining Education Incentive Pay Plan step III , the special assignment pay shall be dropped and the educational pay sub- stituted. D. Should -Education Incentive Pay Plan step III not be attained within the 36 months , or should a transfer from the investigative status occur, the 8 . 25% investigative pay shall immediately be dropped and whatever Education Incentive Pay Plan step that is applicable, if any, shall be substituted. E. Under no circumstances shall a person draw both special assign- ment pay and pay under the Education Incentive Pay Plan. I 2 . EXHIBIT 1 Res.
