HomeMy WebLinkAboutCity Council - 3399 r RESOLUTION NO. 3399 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH TO VACATE A PORTION OF UNION AVENUE, PARK STREET AND THOSE ALLEYS LYING WITHIN THAT PARCEL OF LAND, BOUNDED BY MAIN STREET ON THE WEST, MANSION AVENUE ON THE NORTH, AND 17th STREET ON THE SOUTHEAST, WITHIN SAID CITY AND GIVEN NOTICE OF HEARING ON SAID VACATION. WHEREAS, Union Avenue, Park Street and those alleys lying within that parcel of land, bounded on the West by Main Street, on the North by Mansion Avenue, and on the Southeast by 17th Street, lie within the designated Civic Center boundary site and are no longer necessary for public use and WHEREAS, the vacation of these streets and alleys will not be in conflict with the Master Plan of Arterial Streets and Highways and WHEREAS, the City Council desires to vacate that portion of Park Street, Union Avenue, and these alleys as hereinafter described. NOW THEREFORE, the City Council of the City of Huntington Beach, California does resolve, determine, find and declare as follows: Section 1. The City Council of the City of Huntington does hereby declare its intention to vacte,a portion of Union Avenue, Park Street, and four alleys within the City of Huntington Beach, described as follows: Parcel 1. That portion of Park Street 60.00 feet in width as shown on a map of Tract No. 12 recored in Book 9 .Page 13 of Miscellaneous Maps, Records of Orange County, bounded on the North by the easterly extension of the North line of Block 2002 of said Tract No. 12 and bounded of the South by the easterly extention of the South line of said Block 2002. Parcel 2. That portion of Union Avenue 60.00 feet in width as shown on a map of Tract No. 12 recorded in Book 9 Page 13 of Miscellaneous Maps, Records of Orange County, bounded on the West by the Southerly extension of the West line of Block 2002 of said Tract No. 12 and bounded on the East by the Southwesterly extension of the Southeasterly line of Block 2001 of said Tract No. 12. Parcel 3. An alley 15.00 feet in width within Block 2002 of Tract No. 12 as shown on a map recorded in Book 9 Page 13 of Miscellaneous Maps, Records of Orange County, bounded on the North by the Easterly extension of the North line of Lot 22 of said Block 2002 and bounded on the South by the Easterly extension of the South line of Lot 2 of said Block 2002. Parcel 4. An alley 15.00 feet in width within Block 2001 of Tract No. 12 as shown on a map recorded in Book 9 Page 13 of Miscellaneous Maps Records of Orange County bounded on the North by the Northwesterly extension of the Northeasterly line of Lot 5 of said Block 2001 and bounded on the South by the Westerly extension of South line of Lot 1 of said Block 2001. Parcel 5. An alley 15.00 feet in width within Block 1903 of Tract No. 12 as shown on a map recorded in Book 9 Pam 13 of Miscellaneous Maps Records of Orange County bounded on the North by the Easterly extensionof the North line of Lot 22 of said Block 1903 and bounded on the South by the South- westerly extension of the Southeasterly line of .Lot 1 of said Block 1903. Parcel 6. An alley 15.00 feet in width within Block 1903 of Tract No. 12 as shown on a map recorded in Book 9 Page 13 of Miscellaneous Maps Records of Orange County bounded on the Northeast by the Easterly extension of the North line of Lot 17 of said Block 1903 and bounded on the Southwest by the Southerly extension of the West line of Lot 17 of said Block 1903. Section 2. The City Council of the City of Huntington Beach further declares and stipulates that there will be no reservation or exceptions from the vacation and further stipulates that the fee title to the above described vacated areas shall be considered to passing to the adjacent real properties owned by the City of Huntington Beach, California, in fee. Section 3. That notice is hereby given that the 20th day of December, 1971, at the hour of 7:30 P.M. in the Council Chamber of the City Hall, Huntington Beach. California, is the time and place when and where a public hearing shall be held upon said resolution of intention to vacate said above described portions of Park Street, Union Avenue, and four alleys, at which hearing all persons interested in or objecting to the proposed vacation may be heard. Section 4. The City Clerk is hereby authorized and directed to cause a copy of this resolution of intention to be published in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach, by one insertion prior to the hearing, as set forth in Section 3 hereof. Section 5. The City Council of the City of Huntington Beach, in vacating Park Street, Union Avenue, and the four alleys, as above described, does elect to proceed under the provisions of the Street Vacation Act of 1941, Division 9, Part 5, of the Streets and Highway Code of the State of California. Section 6. , The Street Superintendent is hereby authorized and directed to post notices of street vacation, as required by law. PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California, at a regular meeting thereof held on the 6th day of December, 1971.
