HomeMy WebLinkAboutPersonnel Commission - 2 a 1 � S RESOLUTION NO. 2 A RESOLUTION OF THE PERSONNEL BOARD OF THE CITY OF HUNTINGTON BEACH RECOMMENDING ADOP- TION TO THE CITY COUNCIL OF AMENDMENT OF CHAPTER 18 OF THE HUNTINGTON BEACH ORDINANCE CODE RESOLVED that the Personnel Board of the City of Hunting- ton Beach approves the attached ordinance and recommends its adoption by the City Council of said city PASSED AND ADOPTED by the Personnel Board of the City of Huntington Beach at a regular meeting thereof held on the 24th day of March, 1971. b ' ,/Xhaf rman ATTEST Secretary 70 ;D,agso,,,)e'L. ,ego A ORDINANCE NO . 1642 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY REPEALING, AMENDING AND ADDING CERTAIN SECTIONS OF CHAPTER 18 PERTAINING TO THE PER- SONNEL SYSTEM OF SAID CITY The City Council of the City of Huntington Beach does or- dain as follows SECTION 1. Sections 1812, 1812.1, 1812 .22 1821.3, 1821. 4, 1822 .1, 1822 .2, 1833 , 1834 , 1835, 1836 , and 1837 of Chapter 18 of the Huntington Beach Ordinance Code are hereby repealed. SECTION 2 . The Huntington Beach Ordinance Code is hereby amended by amending Sections 1822, 1831 and 1832 to read as follows . 1822 . PERSONNEL BOARD. FUNCTIONS AND DUTIES. The func- tions and duties of the Personnel Board shall be as provided by Section 808 of the city Charter, by ordinance, by resolu- tion or by minute action of the Council. 1831 . COMPETITIVE SERVICE. Pursuant to Article 10 of the city Charter, it is hereby declared that all departments and appointive officers and employees of the city are Included within the personnel system and the competitive service except : (a) Elective officers . (b) Members of appointive boards , commissions and com- mittees . (c) Persons engaged under contract to supply expert , pro- fessional, technical or other services . (d) Emergency employees who are hired to meet the immedi- ate requirements of an emergency . (e) Employees who are employed to work a regular schedule of less than 1040 hours in any fiscal year. Personnel rules , and regulations , in the form of a Personnel Resolution, shall I be adopted and amended from time to time by the City Council ' following hearings open to the public before the Personnel Board. The Personnel Resolution shall establish specific rules , procedures , including disciplinary and review proce- dures, and regulations governing the administration and operation of the Personnel Board and the personnel system which shall not be inconsistent with the city Charter. SECTION 3. The Huntington Beach Ordinance Code is hereby amended by adding thereto Sections 1812, 1813 , 1814 and 1833 I to read as follows 1 1812 . PERSONNEL DEPARTMENT CREATED. A Personnel De- partment is hereby created and shall be under the supervision and control of a Personnel Director. 1813. PERSONNEL DIRECTOR. A Personnel Director shall be appointed by the City Administrator with the approval of the City Council, and such Personnel Director shall be the head of the Personnel Department . 1814 . DUTIES OF PERSONNEL DIRECTOR. The Personnel Di- rector shall administer the provisions of Chapter 18 of this code , the Personnel Resolution, and the Employer-Employee Relations Resolution. He shall be the city's principal rep- resentative in all matters of employer-employee relations , with authority to meet and confer in good faith with recog- nized employee organizations within the scope of represen- tation. He shall serve as secretary to the Personnel Board . He shall have authority to perform such other duties as may be assigned him by the City Administrator and the Personnel Board not inconsistent with the city Charter, this chapter, and the above-named resolution. 1833. EMPLOYER-EMPLOYEE RELATIONS . An Employer-Em- ployee Relations Resolution shall be adopted and may be amended from time to time by the City Council following hear- ings open to the public before the Personnel Board. SECTION 4 . All provisions and sections in conflict with this ordinance are hereby repealed. SECTION 5. The provisions of this ordinance insofar as they are substantially the same as existing provisions of the Huntington Beach Ordinance Code relating to the same subject matter shall be construed as restatements and continuations , ' and not as new enactments . 2 . The City Clerk shall certify to the pas- sage of this ordinance and cause same to be published within fifteen days after adoption in the Huntington Beach News, a weekly newspaper of general circulation, printed and published in Huntington Beach , California.
