HomeMy WebLinkAboutCity Council - 3415 RESOLUTION NO. 3415 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A POR- TION OF UNION AVENUE, PARK STREET AND THOSE AL- LEYS LYING WITHIN THAT PARCEL OF LAND, BOUNDED BY MAIN STREET, MANSION AVENUE AND SEVENTEENTH STREET WHEREAS , on December 6 , 1971, the City Council of the City of Huntington Beach duly adopted Resolution No . 3399 declaring its intention to vacate a portion of Union Avenue , Park Street and those alleys lying within that parcel of land bounded by Main Street on the west , Mansion Avenue on the north, and Seventeenth Street on the southeast , and referring to a map or plan on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of December 20 , 1971 at the hour of 7 : 30 p .m. , or as soon thereafter as the matter may be heard, in the Council Chambers in City Hall, Huntington Beach, California for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of this resolution. Notices of the proposed vacation were posted conspicuously along that portion of Union Avenue and Park Street , and those por- tions of the alleys lying within a parcel of land bounded by Main Street , Mansion Avenue and Seventeenth Street , proposed to be vacated , and such notices were posted not more than three hundred ( 300 ) feet apart and at least three (3) were posted. On December 20 , 1971 at the hour of 7 : 30 p .m. thereof in Council Chambers in City Hall, Huntington Beach, California, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or object- ing to the vacation of said streets and alleys , at which time 1 . no objection was made to the vacation of a portion of Union Avenue and Park Street , and those portions of alleys lying within a parcel of land bounded by Main Street , Mansion Avenue and Seventeenth Street , and evidence was presented showing that that portion of Union Avenue and Park Street , and those portions of alleys lying within a parcel of land bounded by Main Street , Mansion Avenue and Seventeenth Street are not necessary for present or prospective public street , or alley purposes , and that such vacation will not conflict with the Master Plan of Arterial Streets and Highways , NOW, THEREFORE , the City Council of the City of Huntington Beach, pursuant to Part 3, Division 9 of the State of California Streets and Highways Code (Sections 8300 et seq. ) , does resolve that that portion of Union Avenue and Park Street , and those por- tions of alleys lying within a parcel of land bounded by Main Street , Mansion Avenue and Seventeenth Street are not necessary for present or prospective public street , or alley purposes , and that the proposed vacation will not conflict with the Master Plan of Arterial Streets and Highways , and it is hereby ORDERED that the following described portions of Union Avenue and Park Street , and four alleys within the City of Hunt- ington Beach be and the same are vacated : PARCEL 1 . That portion of Park Street 60 .00 feet in width as shown on a map of Tract No . 12 recorded in Book 9 , page 13 of Miscellaneous Maps , Records of Orange County, bounded on the north by the easterly extension of the north line of Block 2002 of said Tract No. 12 and bounded on the south by the easterly extension of the south line of said Block 2002 . PARCEL 2 . That portion of Union Avenue 60 . 00 feet in width as shown on a map of Tract No . 12 recorded in Book 9 , page 13 of Miscellaneous Maps , Records of Orange County , bounded on the west by the southerly extension of the west line of Block 2002 of said Tract No . 12 , and bounded on the east by the southwesterly extension of the south- easterly line of Block 2001 of said Tract No . 12 . 2 . PARCEL 3 . An alley 15 .00 feet in width within Block 2002 of Tract No . 12 as shown on a map recorded in Book 9 , page 13 of Miscellaneous Maps , Records of Orange County, bounded on the north by the easterly extension of the north line of Lot 22 of said Block 2002 and bounded on the south by the easterly extension of the south line of Lot 2 of said Block 2002 . PARCEL 4 . An alley 15 . 00 feet in width within Block 2001 of Tract No . 12 as shown on a map recorded in Book 9 , page 13 of Miscellaneous Maps , Records of Orange County , bounded on the north by the north- westerly extension of the northeasterly line of Lot 5 of said Block 2001, and bounded on the south by the westerly extension of the south line of Lot 1 of said Block 2001. PARCEL 5 . An alley 15 .00 feet in width within Block 1903 of Tract No . 12 , as shown on a map recorded in Book 9 , page 13 of Miscellaneous Maps , Records of Orange County, bounded on the north by the easterly extension of the north line of Lot 22 of said Block 1903 and bounded on the south by the southwesterly extension of the southeasterly line of Lot 1 of said Block 1903 . PARCEL 6 . An alley 15 .00 feet in width within Block 1903 of Tract No . 12 as shown on a map recorded in Book 9 , page 13 of Miscellaneous Maps , Records of Orange County, bounded on the northeast by the easterly extension of the north line of Lot 17 of said Block 1903 and bounded on the southwest by the southerly ex- tension of the west line of Lot 17 of said Block 1903 . PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 3rd day of January, 1972 .
