A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ESTABLISHING UNDERGROUND UTILITY
DISTRICT NO . 72-2
WHEREAS , by Resolution No . 3406 , a public hearing was
called for January 3 , 1972 at the hour of 7 :30 p .m. , or as soon
thereafter as the matter could be heard, in Council Chambers
of City Hall, Huntington Beach, California, to ascertain
whether the public necessity, health, safety , or welfare re-
quires the removal of poles , overhead wires and associated
overhead structures and the underground installation of wires
and facilities for supplying electric , communication, or simi-
lar or associated service within the right of way of Newland
Street from the north right of way line of Adams Avenue to
two thousand (2000) feet south of Adams Avenue; and
Notice of such hearing has been given to all affected
property owners as shown on the last equalized assessment roll
and utilities concerned in the manner and for the time required
by law; and
Such hearing has been duly and regularly held, and all per-
sons interested have been given an opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Huntington Beach hereby finds and determines that the
public necessity , health, safety and welfare require the removal
of poles , overhead wires and associated structures , and the
underground installation of wires and facilities for supplying
electric , communication, or similar or associated service
within the right of way of Newland Street from the north right
of way line of Adams Avenue to two thousand (2000) feet south of
Adams Avenue , and such described area is hereby established as
1 .
Underground Utility District No . 72-2 .
RESOLVED, FURTHER, that the City Council of the City of
Huntington Beach finds that such undergrounding will avoid or
eliminate an unusually heavy concentration of overhead distri-
bution facilities .
RESOLVED, FURTHER, that all poles , overhead wires and as-
sociated overhead structures shall be removed and underground
installations made in said underground utility district within
the following times :
(a) Underground installation by utility companies and
property owners and reconnections not later than July 1, 1972;
(b ) Removal of poles , overhead wires and other associated
overhead structures not later than July 1 , 1972 .
RESOLVED FURTHER, that the City Clerk, within ten (10) days
after the adoption of this resolution, shall mail a copy hereof
and a copy of Article 975 of the Huntington Beach Ordinance Code
to affected property owners as such are shown on the last equalized
roll and to the affected utilities .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 3rd
day of January , 1972 .

I , PAUL C. JONES, the duly elected, qualified and
acting City Clerk of the City of Huntington Beach, and ex-
officio Clerk of the City Council of said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is seven; that the foregoing
resolution was passed and adopted by the affirmative vote of
more than a majority of all the members of said City Council
at a regular meeting thereof held on the 3rd
day of January 19 72 , by the following vote:
