Home My WebLink AboutCity Council - 3459 RESOLUTION NO. 3459 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE ACQUISI- TION OF REAL PROPERTY GENERALLY LOCATED IN THE BUSHARD-BROOKHURST AREA WHEREAS, it is in the best interests of the City of Huntington Beach to acquire certain real property for a park facility; and DOROTHY T. PECK FLYNN by Bank of America National Trust and Savings Association, BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION as Trustee under the will of Aldrich R. Peck, deceased, and BANK OF AMERICA NATIONAL TRUST AND SAVINGS AS- SOCIATION as Trustees under the written declaration thereof by Carrie A. Peck, Grantors, desire to sell, and the City of Huntington Beach desires to buy, 2 . 0037 acres, generally located in the Bushard-Brookhurst area, and more specifically described in Exhibit "A" attached hereto, NOW, THEREFORE, BE IT RESOLVED' by the City Council of the City of Huntington Beach as follows : 1. That it does hereby agree to buy from DOROTHY T . PECK FLYNN by Bank of America National Trust and Savings Association, BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION as Trustee under the will of Aldrich R. Peck, deceased, and BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION as Trustees under the written declaration thereof by Carrie A. Peck, Grantors , real property, consisting of 2 . 0037 acres, generally located in the Bushard-Brookhurst area, and more specifically described in Ex- hibit "A" attached hereto, for the sum of Sixty Thousand One Hundred Eleven Dollars ($60,111. 00) . 2 . That the Mayor and City Clerk are authorized to exe- cute a contract by and between the city and DOROTHY T . PECK 1. FLYNN by America National Trust and Savings Association, BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION as Trustee under the will of Aldrich R. Peck, deceased, and BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION as Trustees under the written declaration thereof by Carrie A . Peck, Grantors , to ac- quire said 2. 0037 acres to be used for a park facility . 3 . That DOROTHY T. PECK FLYNN by American National Trust and Savings Association, BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION, as Trustee under the will of Aldrich R. Peck, deceased, and BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION as Trustees under the written declaration thereof by Carrie A. Peck, Grantors, shall execute and deliver, and the City Clerk is hereby authorized to accept, a grant deed to the herein described real property. 4 . That the Finance Director is authorized to issue a war- rant in said sum to First American Title Insurance Company in payment.
