HomeMy WebLinkAboutCity Council - 3472 RESOLUTION NO . 3472 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH REQUESTING LIMITED REOPENING OF THE ROUTE ADOPTION FOR THE ROUTE 39 FREEWAY WHEREAS, the California Highway Commission adopted the route location for the Route 39 Freeway between Route l Free- way and Lampson Avenue on October 21, 1968; and Each of the City Councils representing the Cities of Fountain Valley, Huntington Beach and Westminster strongly favor the earliest possible construction of this freeway; and Each of the City Councils strongly endorse the essential need for this freeway to serve the traveling public and the citizens of West Orange County; and Each of the cities agree that the adopted alignment north or Route 405 (San Diego) Freeway is proper and appropriate; and The City Council of the City of Fountain Valley has de- termined that the location of this freeway within the city limits of the City of Fountain Valley is unacceptable, and said City Council has indicated that it will refuse to execute a freeway agreement with the State of California, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach as follows : 1 . The California Highway Commission is requested to re- open the route adoption of the Route 39 Freeway between Route 1 Freeway and Route 405 Freeway . 2 . The California Highway Commission is requested to authorize a feasibility study to consider the adoption of an alternate route from the Route 405 Freeway southwesterly to the vicinity of Gothard and Warner, thence southerly to the Route 1 1. Freeway . It is to be understood that there shall be suf- ficient studies undertaken by the State to determine the en- vironmental impact this route adoption will have upon the area. 3. The City Council of the Cities of Huntington Beach and Westminster hereby agree upon completion of studies and deter- mination by the California Highway Commission of a re-adopted route location, to enter into good faith negotiations with the State of California for completion of freeway agreements . 4 . The City Council of the City of Fountain Valley is presently unable to agree to negotiations concerning a freeway agreement with an adopted route within the city limits of the City of Fountain Valley . 5 . Each of the three City Councils of the Cities of Fountain Valley, Huntington Beach and Westminster jointly agree to cooperate with the state Division of Highways in the completion of studies necessary for the California Highway Commission to make a final determination of the routing of the Route 39 Freeway south of Route 405. 6 . Each of the City Councils of the Cities of Fountain Valley, Hungington Beach and Westminster agree not to request further consideration of alternate routes after reopening and re-adoption of an alignment by the California Highway Commis- sion. 7. It is the intention of the Cities of Fountain Valley, Westminster and Huntington Beach that each said city shall adopt resolutions similar to this resolution, and that such action shall be joint and such resolutions shall be deemed joint reso- lutions .
