HomeMy WebLinkAboutCity Council - 3518 RESOLUTION NO. 3518 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH APPROVING AND IMPLEMENTING A MEMORANDUM OF AGREEMENT WITH THE HUNTINGTON BEACH MUNICIPAL EMPLOYEES ' ASSOCIATION The City Council of the City of Huntington Beach resolves as follows : The Memorandum of Agreement between the City of Huntington Beach and the Huntington Beach Municipal Employees' Association, dated June 30 , 1972 , a copy of which, with its attached exhibits , is marked Exhibit "A" and attached hereto and made a part hereof, is hereby approved and ratified and ordered implemented in accordance with the terms and conditions thereof. BONFA, C' ty A torney B By ty p ty ssistant C Clerk W L S , e MEMORANDUM OF AGREEMENT Between THE CITY OF HUNTINGTON BEACH, CALIFORNIA Hereinafter called CITY and THE HUNTINGTON BEACH MUNICIPAL EMPLOYEES ' ASSOCIATION Hereinafter called ASSOCIATION PREAMBLE This agreement has been reached and prepared after meeting and conferring in good faith between the CITY and ASSOCIATION, pursuant to the provisions of Government Code Sections 3500 through 3510 and Resolution No. 3335 • ARTICLE I Classifications , range numbers and salary ranges to be effect- ive July 1, 1972 shall be as set forth in Exhibits 1 through 4, attached hereto and made part hereof. It is understood that the adjustments made as a result of the Classification Study, conducted and completed by the Personnel Department during the 1971-72 Fiscal Year shall be set forth in Exhibit 5 attached hereto and made part hereof. ARTICLE II The Personnel Department shall conduct a salary survey by the end of February in each of the years 1973, 1974 and 1975. The Personnel Department shall survey the minimums and maximums of the ranges with prime consideration given to the maximum attainable, or top salary step, in the salary range . The agencies surveyed 1. shall include the cities of Long Beach, Anaheim, Santa Ana, Torrance, Fullerton, Orange, Costa Mesa, Newport Beach and the County of Orange . The results of the survey shall be reviewed by the ASSOCIATION and the CITY to determine the CITY 'S competitive position as it relates to the averages determined by the survey . Those classi- fications which are so surveyed and found to be in excess of 1. 37% below the average of the cities surveyed shall receive a minimum of one range adjustments to bring that classification within 1. 37% of the average, such adjustments shall be effective November 1, 1972 It is understood that the survey shall study the functions required of each classification represented by ASSOCIATION and not restricted to job titles . Results of the survey will be concurred with by ASSOCIATION and CITY and internal relationships adjustments shall be made. In the event the survey indicates that the average rates in the survey cities exceed the 5% salary increases payable under Article I hereof, which excess amounts to 1% or more, the fringe benefits shall thereupon be reviewed jointly by ASSOCIATION and CITY to determine mutually agreeable areas of improvement, to which the aforesaid excess shall be applied so as to become effective begin- ning the following July 1. ARTICLE III A joint committee composed of a representative of the ASSOCIA- TION and a representative of the Personnel Department shall study the areas of sick leave accumulation, sick leave freeze, CITY paid long term disability insurance, CITY payment for dependent medical 2 . coverage and all other areas of employee group insurance . Such study shall be completed no later than January 1, 1973 . ARTICLE IV An Education Pay Plan is established for all employees repre- sented by the Huntington Beach Municipal Employees ' Association, with provisions as provided below: 1. Payment shall be made on the basis of one dollar ($1 . 00) per month for each completed college semester unit or its equivalent , limited to 8 . 25% of the employee's basic monthly pay . 2. Payment shall be made only for that education above and beyond the education requirement for the employee 's classi- fication. 3 . Payment shall begin on the first of the month following approval by the Education Committee . 4 . The Education Committee shall be composed of one member appointed by the ASSOCIATION, one member from the Finance Department and one member from the Personnel Department . 5. An employee must be employed by the CITY for one year to be eligible, and only those units for which credit is received after the date of employment shall be eligible for payment . All courses and credit shall be taken on the employee's own time and at the employee ' s own expense . 6 . Transcripts and other proof of credits shall be the sole respon- sibility of the employee . Transcripts and grade cards shall be forwarded to the Education Committee for review and consideration. 7. When an employee is promoted or transferred, his pay, if any, under the Education Pay Plan shall be reviewed to determine continuing eligibility. 3 . 8. Semester units shall be the basis for payment , with 18 hours of instruction the equivalent of one semester unit, and one quarter unit shall be the equivalent of two-thirds (2/3) of a semester unit . 9 . Questions concerning the Education Committee 's determination shall be referred to the Committee. An employee who is not satisfied with the Committee ' s determinations shall present his problem to the Education Committee for review. Determination of the Education Committee may be subject to the Grievance Procedure . 10 . Documents and questions for the Education Committee shall be referred to the Personnel Director for submission to the Committee. 11. All grades must be a letter grade of "C" or better in a "Pass/ Fail" grading system, a "Pass" is required and in a "Credit/ No Credit" grading system, a "Credit" is required to be eligible for approval. 12 . The Education Committee may approve courses in advance to insure that payment will follow completion. An Education Plan Study Committee composed of representatives of the ASSOCIATION and representatives of the CITY shall study the Education Plan for the purpose of determining the most appropriate Education Pay Plan for the employees represented by the ASSOCIATION. Any changes to be made shall be upon mutual agreement between ASSO- CIATION and CITY. ARTICLE V Those employees who are required by the respective Department Directors to wear safety shoes shall be reimbursed for two (2) pairs 4 . of such safety shoes per year with a maximum cost of twenty dollars ($20) per pair. Proof of purchase shall be submitted to the Depart- ment Director for payment . Any exceptions shall be subject to approval of the Department Director. Effective October 1 1972, the CITY shall institute a uniform purchase and replacement program to provide uniforms for those employees required by the Department Director to wear uniforms on the job. ARTICLE VI When promotions are to be made, and two or more employees are found to be equal as a result of promotional examinations conducted by the CITY, the employee with the greatest length of service with the CITY shall receive the promotion. ARTICLE VII Employees shall be entitled to bereavement leave not to exceed three working days per calendar year in each instance of death in the immediate family. Immediate family is defined as father, mother, sister, brother, spouse, children, stepfather, stepmother, step- sisters, stepbrothers, mother-in-law, father-in-law or stepchildren. ARTICLE VIII ASSOCIATION and CITY shall form an ad hoc committee to study the present retirement system and shall prepare a written report with recommendations to the ASSOCIATION-CITY joint committee and the Personnel Board no later than January 1, 1973 . ARTICLE IX The terms and conditions of prior Memoranda of Understanding between the ASSOCIATION and CITY shall continue for the term of 5 . this agreement unless specifically modified by this agreement . ARTICLE X This Memorandum of Agreement shall be in effect for a term commencing July 1, 1972 and ending June 30, 1975. ARTICLE XI It is the understanding of CITY and ASSOCIATION that this Memorandum of Agreement is of no force or effect whatsoever unless or until ratified and approved by Resolution duly adopted by the City Council of the City of Huntington Beach in accordance with Section 8, Resolution No . 3335 • IN WITNESS WHEREOF, the parties hereto have caused this Memo- randum of Agreement to be executed this ..3 0 day of June, 1972.
