HomeMy WebLinkAboutCity Council - 3559 RESOLUTION NO. 3559 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF GOLDENWEST STREET WHEREAS, on August 7, 1972, the City Council of the City of Huntington Beach duly adopted Resolution No . 3545 declaring its intention to vacate a portion of Goldenwest Street in the City of Huntington Beach, and referring to a map or plan on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of Tuesday, September 5, 1972 at the hour of 7 : 00 p .m. , or as soon there- after as the matter may be heard, in the Council Chambers in City Hall, Huntington Beach, California for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of this resolution. Notices of the proposed vacation were posted con- spicuously along that portion of Goldenwest Street proposed to be vacated, and such notices were posted not more than three hundred (300) feet apart and at least three (3 ) were posted. On September 5, 1972 at the hour of 7 : 00 P .M. thereof in Council Chambers in City Hall, Huntington Beach, California, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or object- ing to the vacation of said street, said hearing was continued to October 2, 1972 at the hour of 7 : 00 p .m. , at which time no objection was made to the vacation of a portion of Goldenwest Street and evidence was presented showing that that portion of Goldenwest Street in the City of Huntington Beach is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes , 1 . NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Part 3 , Division 9 of the State of California Streets and Highways Code (Sections 8300 et seq. ) , does resolve that the portion of Goldenwest Street hereinafter set forth is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes , and it is hereby ORDERED that the following described portion of Goldenwest Street in the City of Huntington Beach be and the same is here- by vacated; and said portion of Goldenwest Street so vacated is described as follows : That portion of the southwest quarter of the south- west quarter of the northwest quarter of Section 2 , Township 6 South, Range 11 West , San Bernardino Base and Meridian, in the City of Huntington Beach, County of Orange , State of California, as per map recorded in Book 51, page 14 of Miscellaneous Maps as recorded in the office of the Recorder of said County, described as follows : Beginning at the northeast corner of Tract 6453 as shown on a map recorded in Book 247 , page 24 of Mis- cellaneous Maps , Records of Orange County, thence south 00°17120" west 258 . 83 feet along the east boundary line of said tract , said line also being the southerly prolongation of the centerline of Goldenwest Street , to its intersection with a line parallel with and 15 .00 feet northerly , measured at right angles , from the north line of Mansion Avenue as described in a deed recorded in Book 294 , page 390, of Deeds , Records of Orange County; thence south 89040 ' 17" east 45 . 00 feet along said line to a line in its inter- section with a line parallel with and 45 .00 feet easterly, measured at right angles , from said east boundary line of Tract 6453 ; thence north 00017120" east 1. 29 feet along said line to the True Point of Beginning; thence continuing north 00017120" east 131. 19 feet to a point of cusp with a nontangent curve concave to the northwest having a radius of 920 .00 feet , a radial line through said point bears north 79021102" west ; thence southwesterly along said curve through a central angle of 5051143" an arc distance of 94 . 13 feet to a curve concave to the northeast having a radius of 32 .00 feet ; thence southeasterly along said curve through a central angle of 89043111" an arc distance of 50 .11 feet to the True Point of Beginning. 2 . The city hereby reserves and excepts from the vacation a permanent easement and right at any time or from time to time, to construct , maintain, operate, replace, remove and renew sani- tary sewers , water mains and storm drains and appurtenant struc- tures in, upon, over and across such street or any portion there- of proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise to construct , maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits , cables , wires , poles and other convenient structures , equipment and fix- tures for the operation of gas pipe lines , telegraphic and tele- phonic lines and for the transportation or distribution of electric energy, petroleum and its products , water and incidental purposes , including access and the right to keep the property free from in- flammable materials and wood growth and otherwise protect same from all hazards in, upon and over said Goldenwest Street and that portion proposed to be vacated.
