RESOLUTION NO. 3560 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF ALGONQUIN STREET WHEREAS , on August 7 , 1972 , the City Council of the City of Huntington Beach duly adopted Resolution No . 3536 declaring its intention to vacate a portion of Algonquin Street , located in proposed Tract 5633 , in the City of Huntington Beach , and referring to a map or plan on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of Tuesday, September 5 , 1972 at the hour of 7 : 00 p .m. , or as soon there- after as the matter may be heard, in the Council Chambers in City Hall, Huntington Beach, California for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen ( 15) days from the passage of such resolution. Notice of the proposed vacation were posted con- spicuously along the portion hereinabove set forth proposed to be vacated, and such notices were posted not more than three- hundred ( 300) feet apart and at least three ( 3) were posted. On September 5, 1972 at the hour of 7 :00 p .m. , thereof in Council Chambers in City Hall, Huntington Beach, California, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the vacation of said portion of Algonquin Street, at which time no objection was made to the vacation of a portion of Algonquin Street hereinabove set forth, and evidence was presented showing that a portion of Algonquin Street in the City of Huntington Beach is not necessary for present or prospective public street pur- poses , and is not suitable for use or development as bicycle paths or routes , NOW, THEREFORE , the City Council of the City of Huntington 1 . Beach, pursuant to Part 3, Division 9 of the State of Cali- fornia Streets and Highways Code (Sections 8300 et seq. ) , does resolve that the portion of Algonquin Street hereinafter set forth is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes , and it is hereby ORDERED that the following described portion of Algonquin Street in the City of Huntington Beach be and the same is hereby vacated; and the portion of Algonquin Street is described as : A portion of the eastern half of the southwest quarter of Section 20 , Township 5 South, Range 11 West , in the City of Huntington Beach, County of Orange , State of California, as shown on a map re- corded in Book 51, page 13 of Miscellaneous Maps , records of said county , also being a portion of certain strips of land reserved for roads , rail- roads and ditches , as described in a deed recorded in Book 30 , page 252 of Deeds , and being a portion of an easement conveyed to the County of Orange by deed recorded in Book 1196 on page 153 of official Records , said portion being more particularly de- scribed as follows : Beginning at the intersection of the easterly line of the southwest quarter of said Section 20 with a point on a curve concave to the southeast in the northwesterly right of way line of Warner Avenue , 120 feet wide as described in a deed re- corded in Book 7220 , page 871 of official Records of said county , said curve having a radius of 690 .00 feet , a radial line from said point bearing south 68003 ' 54" east; thence southwesterly along said curve through a central angle of 1050 ' 56" a distance of 22 .27 feet; thence tangent to said curve south 20005 ' 10" west 61. 24 feet more or less to a point on a line parallel with and 30 feet westerly of said quarter section line; thence leaving said right of way line of Warner Avenue and parallel with said quarter section line north 0043122" west 96 .29 feet to a point on a nontangent curve concave to the north having a radius of 47 .00 feet , a radial line from said point bearing north 9004 ' 39" east; thence easter- ly along said curve through a central angle of 37042 '37" a distance of 30 .93 feet more or less to said easterly line of the southwest quarter of said Section 20 ; thence along said easterly line south 0043122" east 23. 15 feet more or less to the point of beginning. 2 . The above description embraces 0 .0397 acres more or less . The bearing north 0143122" west as shown for the center line of Algonquin Street on a Record of Survey Map re- corded in Book 58 , pages 35 and 36 , records of said county, was used as the basis of bearings for the above description. Provided, however, that the city hereby reserves and ex- cepts from the vacation a permanent easement and right at any time or from time to time, to construct , maintain, operate , re- place, remove and renew sanitary sewers , water mains and storm drains and appurtenant structures in, upon, over and across that portion of Algonquin Street to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise to construct , maintain, operate , replace, remove, renew and enlarge lines of pipe , conduits , cables , wires , poles and other convenient structures , equipment and fixtures for the operation of gas pipe lines, telegraphic and telephonic lines and for the transportation or distribution of electric energy, petroleum and its products , water and incidental purposes , including access and the right to keep the property free from inflammable materials and wood growth and otherwise protect same from all hazards in, upon and over said Algonquin Street and that portion to be vacated.
