A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION
OF ELLIS AVENUE
WHEREAS, on August 21, 1972 , the City Council of the City
of Huntington Beach duly adopted Resolution No . 3550 declaring
its intention to vacate a portion of Ellis Avenue, located in
proposed Tract 7601, in the City of Huntington Beach, and
referring to a map or plan on file in the office of the City
Clerk for particulars as to the proposed vacation; and
Said resolution fixed the time and place of Monday ,
September 18, 1972 at the hour of 7 : 00 p .m. , or as soon there-
after as the matter may be heard, in the Council Chambers in
City Hall, Huntington Beach, California for hearing all persons
interested in or objecting to the proposed vacation, which time
was not less than fifteen (15) days from the passage of said
resolution. Notices of the proposed vacation were posted con-
spicuously along that portion of Ellis Avenue proposed to be
vacated, and such notices were posted not more than three
hundred (300) feet apart and at least three (3) were posted.
On September 18, 1972 at the hour of 7 : 00 p .m. thereof in
Council Chambers in City Hall, Huntington Beach, California, the
City Council of the City of Huntington Beach did convene for the
purpose of hearing all persons interested in or objecting to the
vacation of said portion of Ellis Avenue, at which time no
objection was made to the vacation of a portion of Ellis Avenue,
and evidence was presented showing that that portion of Ellis
Avenue, located in proposed Tract 7601, in the City of Huntington
Beach is not necessary for present or prospective public street
purposes , and is not suitable for use or development as bicycle
paths or routes ,

NOW, THEREFORE, the City Council of the City of Huntington
Beach, pursuant to Part 3 , Division 9 of the State of California
Streets and Highways Code (Sections 8300 et seq. ) , does resolve
that the portion of Ellis Avenue located in proposed Tract 7601
hereinafter set forth is not necessary for present or prospective
public street purposes , and is not suitable for use or development
as bicycle paths or routes , and it is hereby
ORDERED that the following described portion of Ellis Avenue
located in proposed Tract 7601 in the City 'of Huntington Beach be
and the same is hereby vacated; and said portion of Ellis Avenue
so vacated is described as follows :
A portion of that certain 40 .00 foot strip of
land in the City of Huntington Beach, County of
Orange , State of California, known as Ellis Avenue
and as shown on map of Tract No . 7 recorded in Book
9 , page 8 of Miscellaneous Maps , records of said
County , described as follows :
Beginning at the intersection of the north line
of said 40 . 00 foot strip with the centerline of
Huntington Street as shown on map of Tract No . 3563
recorded in Book 131, pages 7 to 12 inclusive , of
Miscellaneous Maps; thence west along said north line
167 .99 feet to THE TRUE POINT OF BEGINNING, said
point being on a curve concave southerly and having
a radius of 1042 .00 feet , a radial line through said
point bears north 11°47140" west ; thence westerly
along said curve 139 .01 feet and through a central
angle of 7°38 ' 38" to the beginning of a tangent
reversing curve concave northerly and having a radius
of 958 . 00 feet ; thence westerly along said reversing
curve 7 .92 feet to a point in the southerly line of
the aforesaid 40 .00 foot strip of land; thence west
along said southerly line 305 .42 feet to a point in
the westerly line of the land described in deed to
the Huntington Beach Company recorded in Book 1134 ,
page 154 of Official Records , records of said County;
thence north 0002102" west along said line 20 .00 feet
to a point in the centerline of said Ellis Avenue and
40 .00 foot strip of land; thence west along said
centerline 25 .00 feet to a point in the east right of
way line of the Southern Pacific Railroad Right of
Way ; thence north 0°0 ' 54" east along said right of
way line 20 .00 feet to a point in the north line
of said 40 .00 foot strip of land; thence east along
said north line 471 .67 feet to the TRUE POINT OF
BEGINNING.

PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 18th
day of September, 1972 .

I , PAUL C. JONES, the duly elected , qualified and
acting City Clerk of the City of Huntington Beach, and ex-
officio Clerk of the City Council of said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is seven; that the foregoing
resolution was passed and adopted by the affirmative vote of
more than a majority of all the members of said City Council
at a regular meeting thereof held on the 18th
day of Sevtember , 19__ZZ_, by the following vote:
