A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION
OF McFADDEN AVENUE
WHEREAS, on September 18, 1972, the City Council of the City
of Huntington Beach duly adopted Resolution No . 3566 declaring
its intention to vacate a portion of McFadden Avenue, located
in Tract 7999, in the City of Huntington Beach, and referring
to a map or plan on file in the office of the City Clerk for
particulars as to the proposed vacation; and
Said resolution fixed the time and place of Monday,
October 16, 1972 at the hour of 7 : 00 p .m. , or as soon there-
after as the matter may be heard, in the Council Chambers in
City Hall, Huntington Beach, California for hearing all persons
interested in or objecting to the proposed vacation, which time
was not less than fifteen ( 15 ) days from the passage of said
resolution. Notices of the proposed vacation were posted con-
spicuously along that portion of McFadden Avenue proposed to
be vacated, and such notices were posted not more than three
hundred (300) feet apart and at least three (3) were posted.
On October 16, 1972 at the hour of 7 : 00 p .m. thereof in
Council Chambers in City Hall, Huntington Beach, California,
the City Council of the City of Huntington Beach did convene for
the purpose of hearing all persons interested in or objecting
to the vacation of said portion of McFadden Avenue, at which
time no objection was made to the vacation of a portion of
McFadden Avenue, and evidence was presented showing that that
portion of McFadden Avenue, located in Tract 7999, in the City
of Huntington Beach is not necessary for present or prospective
public street purposes , and is not suitable for use or develop-
ment as bicycle paths or routes ,

NOW, THEREFORE, the City Council of the City of Huntington
Beach,. pursuant to Part 3, Division 9 of the State of California
Streets and Highways Code (Section 8300 et seq. ) , does resolve
that the portion of McFadden Avenue located in Tract 7999
hereinafter set forth is not necessary for present or prospective
public street purposes , and is not suitable for use or develop-
ment as bicycle paths or routes , and it is hereby
ORDERED that the following described portion of McFadden
Avenue located in Tract 7999 in the City of Huntington Beach
be and the same is hereby vacated; and said portion of McFadden
Avenue so vacated is described as follows :
The southerly 13 . 50 feet of the northerly
40 . 00 feet of the southeast quarter of Section 16,
Township 5 south, Range 11 west, S .B .B . & M. , in
the City of Huntington Beach, County of Orange,
State of California.
EXCEPT therefrom that portion thereof lying
westerly of the easterly line of Tract No . 7090,
as shown on map recorded in Book 272, pages 32
and 33 of Miscellaneous Maps in the office of the
County Recorder of said County .
ALSO EXCEPTING therefrom that portion thereof
lying easterly of the following described line :
Beginning at the northeast corner of said Tract No .
7090, being a point on the northerly line of the
southeast quarter of said Section 16; thence north
89°38 ' 55" east 902 . 00 feet along said northerly
line to the TRUE POINT OF BEGINNING; thence south
0040 ' 30" east 40 . 00 feet to the point of ending.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 16th
day of October, 1972 .

I , PAUL C. JONES, the duly elected, qualified and
acting City Clerk of the City of Huntington Beach, and ex-
officio Clerk of the City Council of said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is seven; that the foregoing
resolution was passed and adopted by the affirmative vote of
more than a majority of all the members of said City Council
at a regular meeting thereof held on the 16th
day of October , 19 72 , by the following vote:
