HomeMy WebLinkAboutCity Council - 3617 RESOLUTION N0. 3617 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH OF INTENTION TO VACATE A PORTION OF ALGONQUIN STREET The City Council of the City of Huntington Beach does hereby resolve as follows : SECTION 1. Pursuant to Division 9 , Part 3 , Chapter 2 of the Streets and Highways Code of the State of California (Sections 8320 et seq . ) , the City Council of the City of Huntington Beach hereby declares its intention to vacate a portion of Algonquin Street, located in proposed Tract 5633 , in the City of Huntington Beach, described as follows : A portion of the eastern half of the northwest quarter of Section 29 , Township 5 South, Range 11 West , in the City of Huntington Beach, County of Orange , State of California, as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps , records of said county, also being a portion of certain strips of land reserved for roads , rail- roads and ditches , as described in a deed recorded in Book 30, page 252 of Deeds , and being a portion of an easement conveyed to the County of Orange by deed recorded in Book 1196 on page 153 of official records , said portion being more particularly described as follows : Beginning at the intersection of the easterly line of the northwest quarter of said Section 29 with a point on a curve concave to the southeast in the northwesterly right of way line of Warner Avenue , 120 feet wide as described in a deed recorded in Book 7220 , page 871 of official records of said county , said curve having a radius of 690 .00 feet , a radial line from said point bearing south 68103 ' 54" east; thence southwesterly along said curve through a central angle of 1050 ' 56" a distance of 22 . 27 .feet; thence tangent to,, sa1d,.curve south 200 05 ' 10" west 61 .24 feet more or less to a point on a line parallel with and 30 feet westerly of said 1 . quarter section line; thence leaving said right of way line of Warner Avenue and parallel with said quarter section line north 0143122" west 96 . 29 feet to a point on a nontangent curve concave to the north having a radius of 47 .00 feet, a radial line from said point bearing north 9004 ' 3911 east ; thence easterly along said curve through a central angle of 37042 ' 37" a distance of 30 .93 feet more or less to said easterly line of the northwest quarter of said Section 29 ; thence along said easterly line south 0043122" east 23 . 15 feet more or less to the point of beginning. The above description embraces 0 .0397 acres more or less . The bearing north 0°43122" west as shown for the center dine of Algonquin Street on a Record of Survey Map recorded in Book 58 , pages 35 and 36 , records of said county, was used as the basis of bearings for the above description. The city hereby reserves and excepts from the vacation a permanent easement and right at any time or from time to time , to construct , maintain, operate , replace , remove and renew sani- tary sewers , water mains and storm drains and appurtenant struc- tures in, upon, over and across such street or any portion there- of proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise to construct , maintain, operate , replace , remove , renew and enlarge lines of pipe , conduits , cables , wires , poles and other convenient structures, equipment and fix- tures for the operation of gas pipe lines , telegraphic and tele- phonic lines and for the transportation or distribution of electric energy, petroleum and its products , water and incidental purposes , including access and the right to keep the property free from inflammable materials and wood growth and otherwise protect same from all hazards in, upon and over said Algonquin Street and that portion proposed to be vacated. SECTION 2 . The City Clerk is directed to maintain on file in the office of the City Clerk maps or plans showing the par- ticulars of the proposed vacation of the portion of Algonquin Street hereinabove set forth and reference is hereby made to said maps or plans for said particulars as to said proposed vacation. 2 . SECTION 3 . The City Council does hereby fix January 15, 1973 at the hour of 7 : 00 p.m. , or as soon thereafter as the matter may be heard in Council Chambers in City Hall, Huntington Beach, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. SECTION 4 . The City Clerk is directed to cause a copy of this resolution to be published in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach within fifteen ( 15) days of the passage of this resolution. SECTION 5 . The Street Superintendent is directed to post, or cause to be posted, notices of street vacation conspicuously along that portion of Algonquin Street proposed to be vacated at least ten (10 ) days before the date of hearing. Such notices shall be posted not more than three hundred (300) feet apart , but at least three (3) shall be posted. Such notices shall state the passage of this resolution of intention and the time and place of the hearing. SECTION 6 . This resolution rescinds Resolution No . 3536 and Resolution No . 3560 . PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 18th day of December, 1972 .
