HomeMy WebLinkAboutCity Council - 3623 RESOLUTION NO. 3623 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA DECLARING CERTAIN PARCELS OF LAND TO BE PUBLIC STREET RIGHT OF WAY IN THE CITY OF HUNTINGTON BEACH, CALIFORNIA WHEREAS, there are existing parcels of land, commonly known as the east one-half of Lynn Street, as the west one-half of Sims Street, and as the east one-half of Sims Street, within the city limits of Huntington Beach; and These strips of land are known as private roads on the map of Tract No. 86, Coast Boulevard Farms, recorded in Book 10, page 36 of Miscellaneous Maps, Records of Orange County, California; and The map of said Tract No. 86 provides reservation, of ingress and egress, over these strips of land for the owners of the lots within the tract which encompassed approximately 340 acres of land; and WHEREAS, the owners of properties within this area of the city have peti- tkned the City Council of the city of Huntington Beach to form an improvement district under the 1913 Act proceedings; and Provisions of the 1913 Act stipulate that work assessable under the pro- ceedings must occur within a public right of way; and WHEREAS, the City Council of the city of Huntington Beach does hereby declare its intention to consider the formation of the improvement district, and that the formations are predicted upon the city having the public right of way, and that said formations will be of benefit to the general public, and WHEREAS, the City Council of the city of Huntington Beach have received affidavits, from both private citizens living within the area and public service agencies, certifying that general public traffic have used these strips of land as street purposes for a period of at least five years, last past; and The City Council of the city of Huntington Beach, does hereby find these affidavits to be undisputed and sufficient evidence to warrant declarations Resolution No. 3623 of these streets to be public rights of way, pursuant to Division 7, Part 1, Section 5014, of the Streets and Highways Code of the State of California. NOW, THEREFORE, the City Council of the city of Huntington Beach does hereby declare the below described parcels of land to be for public use, to wit: road purposes, and does hereby declare road purposes to be synonymous with present day deed language of public street and utility purposes. These parcels of land lying within Tract No. 86, Coast Boulevard Farms, as shown on a map recorded in Book 10, page 36, Records of Orange County, California, described below: Parcel 1: The easterly 25 feet of Lots 2 and 4 of Block 13. Parcel 2: The westerly 25 feet of Lot 3 of Block 14. Parcel 3: The westerly 25 feet of Lot 3 of Block 11. That the City Clerk shall certify to the passage of and adoption of this resolution and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the city of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take effect and be in force.
