HomeMy WebLinkAboutCity Council - 3661 RESOLUTION N0. 3661 A RESOLUTION OF THE CITY OF HUNTINGTON BEACH SUPPORTING THE CITY COUNCIL OF THE CITY OF LOS ALAMITOS , OPPOSING THE ATTEMPT TO ALTER THE METHOD OF DISTRIBUTION OF THE UNIFORM SALES AND USE TAX WHEREAS the City of Los Alamitos is opposing an attempt , through legislation or litigation, to alter the method of dis- tributing the uniform sales and use tax under the Bradley-Burns Uniform Local Sales and Use Tax Law for the following reasons : 1. Many cities have made moral and legal commitments for the expenditure of local sales and use tax revenues upon the premise that their right and authority to levy, collect and expend the same would not be abrogated and impaired; 2 . Local agencies of government that receive substantial amounts of local sales and use tax revenues do so by reason of long range planning and zoning practices that permit location of businesses within their boundaries and that cities attempting to change the distribution of sales tax revenue to a basis favoring population density have , in many cases , systematically and purposely excluded business and industry by restrictive zoning practices . 3 . Differences between the jurisdictions in per capita amounts of sales tax revenue under the point-of-sale distribution formula do not deprive any citizen of equal protection under the law, but are a direct result of the land use and zoning policies of those jurisdictions and a distribution of revenue on a point- of-sale basis is justified by the cost of providing municipal services to industrial and commercial areas which by their nature require higher levels of some services than do residential areas of corresponding size . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that it supports the City of Los Alamitos er 1 . in its opposition to any attempt to alter the method of dis- tribution of the uniform local sales and use tax under the Bradley-Burns Uniform Local Sales and Use Tax Law. BE IT FURTHER RESOLVED that the City Clerk is directed to furnish copies of this resolution to appropriate state legislators and agencies .
