HomeMy WebLinkAboutCity Council - 3681 RESOLUTION N0. 3681 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH OF INTENTION TO VACATE A PORTION OF SANDRA LEE LANE ' The City Council of the City of Huntington Beach does hereby resolve as follows : SECTION 1 : Pursuant to Division 9 , Part 3 , Chapter 2 of the Streets and Highways Code of the State of California (Sections 8320 et seq. ) , the City Council of the City of Huntington Beach hereby declares its intention to vacate a portion of Sandra Lee Lane , located in Tract No . 349 between the cul-de-sac improvements and Warner Avenue , in the City of Huntington Beach, described as follows : That portion of Tract No . 349 in the city of Huntington Beach, County of Orange , State of California as shown on a map recorded in book 15 page 17 of Miscellaneous Maps in the office of the County Recorder of said County , described as follows : Beginning at the southwest corner of lot 17 of block "J" of said tract No. 349 thence north 00 43 ' 30" west 15 . 86 feet along the west line of said lot 17 to a point on the southeasterly right of way line of Warner Avenue as des- cribed in a deed recorded in book 8269 page 243 of official records in the office of the County Recorder of said County , said right of way being a curve concave to the southeast having a radius of 570 .00 feet a radial line to said point bears south 300 20 ' 31" east ; thence southwester- ly along said curve and right of way thru a central angle of 2° 56 ' 04" an arc distance of 29 .19 feet to the center- line of Sandra Lee Lane shown as a private street on said map of Tract No. 349; thence south 01 43 ' 30" east 34 .36 feet along said centerline to a point on a curve concave to the southwest having a radius of 40 .00 feet , a radial line to said point bears north 13' 45 ' 09" east ; thence southeasterly along said curve thru a central angle of 57' 38 ' 13" an arc distance of 40 . 23 feet to a point on the south line of lot 15 of said block "J" ; thence north 890 41 ' 24" east 1 . 93 feet along said south line to the east line of the west 5 .00 feet of said lot 15; thence north 00 43 ' 30" west 60 .00 feet along said east line to the south line of said lot 17 ; thence south 890 41 ' 24" west 5 . 00 feet to the point of beginning. 1 . The city hereby reserves and excepts from the vacation a permanent easement and right at any time or from time to time , to construct , maintain, operate, replace , remove and renew sanitary sewers , water mains and storm drains and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be vacated and pursuant to any existing franchises or renewals hereof, or otherwise to construct , main- tain, operate , replace , remove , renew and enlarge lines of pipe , conduits , cables , wires , poles and other convenient structures , equipment and fixtures for the operation of gas pipe lines , telegraphic and telephonic lines and for the trans- portation or distribution of electric energy, petroleum and its products , water and incidental purposes , including access and the right to keep the property free from inflammable materials and wood growth and otherwise protect same from all hazards in, upon and over said Sandra Lee Lane and that portion proposed to be vacated. SECTION 2 . The City Clerk is directed to maintain on file in the office of the City Clerk a map or plan showing the parti- culars of the proposed vacation of the portion of Sandra Lee Lane hereinabove set forth and reference is hereby made to said map or plan for said particulars as to said proposed vacation. SECTION 3 . The City Council does hereby fix June 4, 1973 , at the hour of 7 :00 p .m. , or as soon thereafter as the matter may be heard in Council Chambers in City Hall, Huntington Beach, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. SECTION 4 . The City Clerk is directed to cause a copy of this resolution to be published in the Huntington Beach News , a newspaper of general circulation, printed and published in the City of Huntington Beach within fifteen (15) days of the passage of this resolution. SECTION 5 . The Street Superintendent is directed to post , or cause to be posted, notices of street vacation conspicuously 2 . along that portion of Sandra Lee Lane proposed to be vacated at least ten (10) days before the date of hearing. Such notices shall be posted not more than three hundred (300) feet apart , but at least three (3) shall be posted. Such notices shall state the passage of this resolution of intention and the time and place of the hearing.
