HomeMy WebLinkAboutCity Council - 3695 RESOLUTION NO . 3695 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF SANDRA LEE LANE WHEREAS , on May 7 , 1973 , the City Council of the City of Huntington Beach duly adopted Resolution No . 3681 declar- ing its intention to vacate a portion of Sandra Lee Lane in the City of Huntigton Beach, and referring to a map or plan on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of Monday, June 4 , 1973 at the hour of 7 :00 p .m. , or as soon thereafter as the matter may be heard , in the Council Chambers in City Hall, Huntington Beach, California for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed vacation were posted conspicuously along that portion of Sandra Lee Lane proposed to be vacated, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted . On June 4 , 1973 at the hour of 7 : 00 p .m. thereof in Council Chambers in City Hall , Huntington Beach , California, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of a portion of Sandra Lee Lane , at which time no objection was made to said vacation, and evidence was presented showing that the portion of Sandra Lee Lane proposed to be vacated is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes , NOW, THEREFORE , the City Council of the City of Huntington Beach, pursuant to Part 3 , Division 9 of the State of California 1 . Streets and Highways Code (Sections 8300 et seq. ) , does resolve that the portion of Sandra Lee Lane hereinafter set forth is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes , and it is hereby ORDERED that the following described portion of Sandra Lee Lane in the City of Huntington Beach be and the same is hereby vacated; and said portion of Sandra Lee Lane so vacated is described as follows : That portion of Tract No . 349 in the city of Huntington Beach, County of Orange , State of California as shown on a map recorded in book 15 page 17 of Miscellaneous Maps in the office of the County Recorder of said County, described as follows : Beginning at the southwest corner of lot 17 of block "J" of said tract No. 349 thence north 00 43 ' 30" west 15 . 86 feet along the west line of said lot 17 to a point on the southeasterly right of way line of Warner Avenue as des- cribed in a deed recorded in book 8269 page 243 of official records in the office of the County Recorder of said County , said right of way being a curve concave to the southeast having a radius of 570 .00 feet a radial line to said point bears south 300 20 ' 31" east ; thence southwester- ly along said curve and right of way thru a central angle of 20 561 0411 an arc distance of 29 .19 feet to the center- line of Sandra Lee Lane shown as a private street on said map of Tract No. 349 ; thence south 00 43 ' 30" east 34 . 36 feet along said centerline to a point on a curve concave to the southwest having a radius of 40 .00 feet , a radial line to said point bears north 130 45 ' 09" east ; thence southeasterly along said curve thru a central angle of 570 38 ' 13" an arc distance of 40 . 23 feet to a point on the south line of lot 15 of said block "J" ; thence north 890 411 24" east 1 . 93 feet along said south line to the east line of the west 5 . 00 feet of said lot 15 ; thence north 00 43 ' 30" west 60 .00 feet along said east line to the south line of said lot 17 ; thence south 890 41 ' 2411 west 5 . 00 feet to the point of beginning. The city hereby reserves and excepts from the vacation a permanent easement and right at any time or from time to time , to construct , maintain, operate , replace , remove and renew sanitary sewers , water mains and storm drains and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be vacated and pursuant to any existing 2 . franchises or renewals hereof, or otherwise to construct , main- tain, operate , replace , remove , renew and enlarge lines of pipe, conduits , cables , wires , poles and other convenient structures , equipment and fixtures for the operation of gas pipe lines , telegraphic and telephonic lines and for the trans- portation or distribution of electric energy , petroleum and its products , water and incidental purposes , including access and the right to keep the property free from inflammable materials and wood growth and otherwise protect same from all hazards in, upon and over said Sandra Lee Lane and that portion proposed to be vacated.
