HomeMy WebLinkAboutCity Council - 3751 RESOLUTION NO . 3751 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF McFADDEN AVENUE WHEREAS, on August 6, 1973 the City Council of the City of Huntington Beach duly adopted Resolution No . 3734 declaring its intention to vacate a portion of McFadden Avenue in the City of Huntington Beach, and referring to a map or plan on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of Tuesday, September 4 , 1973 at the hour of 7 : 00 p .m. , or as soon there- after as the matter may be heard, in the Council Chambers in City Hall, Huntington Beach, California for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15 ) days from the passage of said resolution. Notices of the proposed vacation were posted con- spicuously along that portion of McFadden Avenue proposed to be vacated, and such notices were posted not more than three hundred (300 ) feet apart and at least three (3) were posted. On September 4 , 1973 , at the hour of 7 : OO p .m. thereof in Council Chambers in City Hall, Huntington Beach, California, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or object- ing to the proposed vacation of a portion of McFadden Avenue , at which time no objection was made to said vacation, and evidence was presented showing that the portion of McFadden Avenue proposed to be vacated is not necessary for present or prospective public street purposes, and is not suitable for use or development as bicycle paths or routes . 1 . NOW, THEREFORE , the City Council of the City of Huntington Beach, pursuant to Part 3 , Division 9 of the State of California Streets and Highways Code (Sections 8300 et seq. ) , does resolve that the portion of McFadden Avenue hereinafter set forth is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes , and it is hereby ORDERED that the following described portion of McFadden Avenue in the City of Huntington Beach be and the same is hereby vacated; and said portion of McFadden Avenue so vacated is described as follows : That portion of the southeast quarter of Section 16 , Township 5 south, Range 11 west, in the Rancho La Bolsa Chica, in the City of Huntington Beach, County of Orange, State of California, as shown on map recorded in Book 51, page 13 of Miscellaneous Maps in the office of the County Recorder of said county , more particularly described as follows : Beginning at the northeast corner of Tract No . 7999 , as shown on map recorded in Book 311, pages 24 and 25 Miscellaneous Maps , records of said county, said corner being a point on the center line of McFadden Avenue , 80 .00 feet in width; thence south 0040 ' 30" east 26 . 50 feet along the east line of said Tract No. 7999 to the true point of beginning; thence north 891 38 ' 55" east 55 .00 feet parallel with said center line of McFadden Avenue thence south 87°22148" east 260 . 43 feet to a point on the south line of said McFadden Avenue distant thereon north 890 38 ' 55" east 315 . 00 feet from the east line of said Tract No. 7999 ; thence along said south line south 89038 ' 55" west 315 .00 feet to said east line ; thence along said east line north 0140 ' 30" west 13 . 50 feet to the true point of beginning.
