A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH SUSPENDING A CONTRACT WITH SOUTH-
WESTERN CONCRETE INC .
WHEREAS , Southwestern Concrete, Incorporated did enter
into a contract with the City of Huntington Beach to conduct
certain repair work with regard to the Overmeyer Reservoir;
and
Said contractor has failed to supply an adequate working
force, material of proper quality, and has failed to prosecute
the work with the diligence and force specified and intended
by the terms of the contract , and has failed to provide means
for a satisfactory compliance with the contract; and
Paragraph 8-i of the contract ' s General Requirements
provides for suspension of same by the City Council,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby suspend the operation of the aforesaid contract
with Southwestern Concrete Inc. , . and the Public Works Department
is hereby authorized to take possession of all or any part
of the contractor ' s materials , tools , equipment and appli-
ances upon the premises , and to use the same for the purpose
of completion of said contract and do whatever else is necessary
and provided for by paragraph 8-i of the General Requirements ,
including the reletting of the Job , so as to complete
lete the nec-
essary work.
BE IT FURTHER RESOLVED that the surety shall remain liable
as provided by the aforesaid paragraph 8-i .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 4th
