A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH APPROVING THE EXECUTION OF
A JOINT POWERS AGREEMENT WITH COAST COMMUNITY
COLLEGE DISTRICT FOR THE CONSTRUCTION OF AN
AMPHITHEATER ON THE GOLDEN WEST COLLEGE
WHEREAS, Coast Community College District maintains
and operates Golden West College; and
WHEREAS , the college is located within the City of
Huntington Beach and City and District both desire to pro-
mote cultural and recreation programs for the people of
the community,
NOW, THEREFORE, the City Council of the City of
Huntington Beach hereby approves the Joint Powers Agreement
between the City and the District , a copy of which is attached,
providing for expenditure of the sum of $11,950 .00 pursuant to
said contract and authorizing the Mayor and City Clerk to
execute said agreement .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 17th
day of September, 1973 .

that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
at a regular meeting thereof held on the 17th day

AGREEMENT
THIS AGREIEMENT is by' and between the CITY OF
HUNTINGTO]U M-ACH, a municipal corporation, hereinafter
referred to as "City" and ' COAST COi t1UNITY COLLEGE DISTRICT
OF ORANGE COUNTY, CALIFORNIA, hereinafter referred to as
"District" .
• WHEREAS, DISTRICT maintains and operates Golden
West College; and
WHEREAS , ' the college is located within the
boundaries of the Cityr of Huntington Beach and CITY and
DISTRICT both desire to facilitate cultural and recreational
programs of the people of the community and DISTRICT
has provided plans for a new airphitheater on the college

campus and CITY and DISTRICT desire to m-zfl e use of sueh
facility for the benefit of the community,
NOW, THEREFORE:, in consideration of the above
the parties heroto do agree as follows .
1) DISTRICT shall construct the com:iunity
amphitheater on the Golden West College in accord-
ante frith the Prospectus attached hereto an
incorporated
herein as Exhibit A . �(,Phase I only.)
2) CITY shall pay to DIS'.NZICT the suin of
Eleven Thou-, and :line Hundred Fifty Dollars

•the construction of- the community amphitheater pursuant
to Phase I as set out in Exhibit A . Payment of this sum
of money shall be made Capon completion of Phase I and
written acknowledgment of completion by CITY .
3) CITY's participation herein is solely
financial and CITY shall in no ►gay be responsible for any
liability which may be inctarred. as the result of the
construction and use of the subject amphitheater.
4) DISTRICT sha12 •indemnify and save harmless
CITY against any and all damages to property or injuries
to or death of any person or persons, and shall defend,
indemnify, and save harmless CITY from any and all clairis ,
demands., suits, actions or proceedings of any kind or nature
in any way resulting from or arising out of the performance
and execution of this Agreement
•5) DISTRICT shall make ,the amphitheater available
to CITY for use on a periodic basis upon request by CITY and `
such use shall have preference over use by any other entity
except use by DISTRICT itself. Use by DISTRICT itself
shall include use by any college maintained and operated
by DISTRICT and use'-by any student , faculty or other group
Affiliated with such college .
6) In the event DISTRICT Is unable to construct
and develop the amphitheater so- that it .is available for
use by October 1 , 1974 , DISTRICT shall upon written request

a PROSPECTUS
ON
PHASE ONE DEVELOPMENT
COMMUNITY AMPHITHEATER: GOLDEN WEST COLLEGE CAMPUS
A proposal : City of Huntington Beach participation with Coast Community
College District-Golden West College in the Phase I (only) development of
a community amphitheater on the college campus at a site west of Gothard
Street between McFadden and Edinger. Distribution of development services
and financial outlays are as follows :

1 . Land-CCC District (approx. 1 acre) $120,000
2 . Site Improvements:
Existing imported soil as roughly graded (6, 000 yards) $ 18,000
Additional imported soil as tailgate deposits only (2, 0OO yards)

Notes on Phases II and III:
Phase II and Phase III developments are anticipated; neither local
civic supj.-srt nor college district outlays are to be solicited for
additional developments , or construction. Rather, it is the intent
of the college community (Faculty and Associated Students , GWC) to
seek private funding in support of these ,projects after the base
environmental setting has been established.
Phase II facilitating will include : permanent flood and stage area
lightings; permanent outdoor sound systems ; stage and set design
fixtures and appurtenances .
Phase III construction will include : permanent lighting and sound
control booth housing; public restrooms on site ; snack bar on site ;
ticket booths at heads of entrance trails .
