HomeMy WebLinkAboutCity Council - 3767 RESOLUTION NO. 3767 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF CLAY AVENUE AND BEACON HILL LANE WHEREAS , on September 4 , 1973 the City Council of the City of Huntington Beach duly adopted Resolution No . 3755 declaring its intention to vacate a portion of Clay Avenue and Beacon Hill Lane in the City of Huntington Beach, and referring to a map or plan on file in the office of the City Clerk for par- ticulars as to the proposed vacation; and Said resolution fixed the time and place of Monday, October 1, 1973 at the hour of 7 :00 p .m. , or as soon there- after as the matter may be heard, in the Council Chambers in City Hall, Huntington Beach, California for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed vacation were posted con- spicuously along that portion of Clay Avenue and Beacon Hill Lane proposed to be vacated, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted. On October 1, 1973, at the hour of 7 :00 p.m. thereof in Council Chambers in City Hall, Huntington Beach, California, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or object- ing to the proposed vacation of a portion of Clay Avenue and Beacon Hill Lane , at which time no objection was made to said vacation, and evidence was presented showing that the portion of Clay Avenue and Beacon Hill Lane proposed to be vacated is not necessary for present or prospective public street purposes and is not suitable for use or development as bicycle paths or routes . lm 1 . NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Part 3 , Division 9 of the State of California Streets and Highways Code (Section 8300 et seq. ) , does resolve that the portion of Clay Avenue and Beacon Hill Lane hereinafter set forth is not necessary for present or prospective public street purposes , and is not suitable for use or development as bicycle paths or routes , and it is hereby ORDERED that the following described portion of Clay Avenue and Beacon Hill Lane in the City of Huntington Beach be and the same is hereby vacated; and said portion of Clay Avenue and Beacon Hill Lane so vacated is described as follows : In the City of Huntington Beach, County of Orange , State of California, being a portion of Clay Avenue and Beacon Hill Lane as shown on a map of Tract 7656 recorded in Book 295, pages 28 through 31 of Miscellaneous Maps , Records of said County, more particularly described as follows : Beginning at a point on the northerly boundary of Lot Number One of Tract 7421 as shown on a map recorded in Book 302 , pages 20 through 23 of said Miscellaneous Maps, said point being a point of reverse curve to which a radial bears north 19035134" east; thence , easterly and southerly along said boundary of Lot One the following several courses and distances : easterly, along a curve concave southerly and having a radius of 32 .00 feet through a central angle of 13015 , 14" an arc length of 7 .40 feet to a point to which a radial bears north 32°50148" east , thence south 32050148" west 4 .00 feet , along last said radial to a point on a curve concave southwesterly and having a radius of 28 . 00 feet, a radial to last said curve bears north 32°50148" east , thence easterly and southerly along last said curve through a central angle of 59059 ' 52" an arc length of 29 . 32 feet to a point to which a radial bears south 87009120" east , thence south 87009120" east 4 . 00 feet along the prolongation of last said radial to a point on a curve concave westerly and having a radius of 32 .00 feet, a radial to last said curve bears south 87009120" east , thence southerly along last said curve through a central angle of 13015 '13" an arc length of 7 .40 feet to a tangent line, thence south 160 05 ' 53" west 0 . 40 feet along said tangent line , 2 . thence leaving said boundary of Lot One , south 77031134" east 1 .60 feet to a point on a curve concave westerly and having a radius of 32 .00 feet , a radial to last said point bears south 70001, 4811 east , thence northerly along last said curve through a central angle of 13044120" an arc length of 7 .67 feet to a point to which a radial bears south 83046 , 08" east , thence north 83046108" west 4 .05 feet along last said radial, to a point on a curve concave southwesterly and having a radius of 28 .00 feet a radial to last said point bears south 87008145" east , thence northerly and westerly along last said curve through a central angle of 60007 ,46" an arc length of 29 .38 feet to a point to which a radial bears north 32043129" east , thence north 34026 ' 36" east 3 .16 feet to a point on a curve concave southerly and having a radius of 32 .00 feet , a radial to last said point bears north 36007121" east , thence westerly along last said curve through a central angle of 16°31147" an arc length of 9 . 23 feet to the point of beginning.
