HomeMy WebLinkAboutCity Council - 3784 RESOLUTION NO. 3784 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE PERSONNEL DIRECTOR TO MAKE DETERMINATION WITH RESPECT TO EMPLOYEE DISABILITY ON BEHALF OF SAID CITY WHEREAS, the City of Huntington Beach (hereinafter re- ferred to as Agency) is a contracting agency of the Public Employees ' Retirement System; and WHEREAS, the Public Employees ' Retirement Law requires that a contracting agency determine whether an employee of such agency in employment in which he is classified as a local safety member is disabled for purposes of the Public Employees ' Re- tirement Law and whether such disability is "industrial" within the meaning of such law; and WHEREAS, the City Council has determined upon legal ad- vice that it may delegate authority to make such determina- tions to the incumbent of the position of Personnel Director; NOW, THEREFORE, BE IT RESOLVED: That the City Council delegate and it does hereby dele- gate to the incumbent of the position of Personnel Director authority to make determinations under Section 21023 .6, Govern- ment Code, on behalf of the Agency, of disability and whether such disability is industrial and to certify such determina- tions and all other necessary information to the Public Em- ployees' Retirement System; and BE IT FURTHER RESOLVED that such incumbent be and he is authorized to make applications on behalf of the Agency for disability retirement of employees in employments in which they are local safety members and to initiate requests for reinstatement of such employees who are retired for disability. 1. /ahb PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 19th day of November, 1973 .
