HomeMy WebLinkAboutCity Council - 3793 RESOLUTION NO . 3793 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH STATING THE RESULT OF THE CANVASS OF ELECTION RETURNS OF THE SPECIAL MUNICIPAL ELECTION HELD NOVEMBER 6, 1973 WHEREAS, the City Council of the City of Huntington Beach by Resolution No. 3737 duly called and provided for the hold- ing of a special election in said city on November 6, 1973, for the purpose of submitting to the qualified voters of said city the propositions set forth in said resolution and herein- after stated; and The City Council of said City of Huntington Beach did request the Registrar of Voters of Orange County, California to include said special election for the City of Huntington Beach with a special initiative election being held by the County of Orange for the State of California; and Notice of said election was duly and regularly given in time, form and manner as provided by law, and said election was duly held on said date at the polling places designated by said County of Orange; and The Registrar of Voters of the County of Orange did on November 12, 1973 issue a certification of the statement of vote for the City of Huntington Beach special municipal elec- tion consolidated with the special initiative election held November 6, 1973, and that the votes cast in the special elec- tion of the City of Huntington Beach are as follows : 1. /ahb ' PROPOSED CHARTER AMENDMENT: ' City Charter Sections 500, ' ' ' 501, 503, 703 and 707 shall ' YES ' ' be amended to provide that ' ' ' the position of City ' ' ' Attorney shall be appointed ' ' ' by the City Administrator ' ' ' subject to the approval of ' NO ' ' the City Council. r t T t t YES VOTES - 11, 674 NO VOTES - 15, 522 ' PROPOSED CHARTER AMENDMENT: ' ' ' City Charter Sections 500, ' YES ' 501, 502, 503, 704, and 707 ' ' ' shall be amended to provide ' ' ' that the position of City t t ' Clerk shall be appointed by ' ' ' the City Administrator sub- ' NO ' ' ject to the approval of the ' ' ' City Council. r r t t YES VOTES - 12,007 NO VOTES - 15,128 ' PROPOSED CHARTER AMENDMENT: ' ' ' City Charter Sections 500, ' ' ' 501, 502, 503, 705 and 707 ' YES . ' ' ,. t t YES VOTES - 11, 506 NO VOTES - 15,663 As provided in the California Constitution, the city Charter may be amended by majority vote of its electors voting on the question. 2. NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve, determine and order as follows: SECTION 1. That the special election for the purpose of submitting to the voters of the City of Huntington Beach the propositions hereinafter set forth was duly held on November 6, 1973, and the votes cast at said election were duly and regu- larly canvassed and the returns thereof made at the time and in the form and manner required by law. SECTION 2 . That the prosisions voted upon at said elec- tions were numbered "A, " "B, " and "C" and were as follows : CHARTER AMENDMENT "A: " City Charter Sections 500, 501, 503, 703 and 707 shall be amended to provide that the position of City Attorney shall be appointed by the City Administrator subject to the approval of the City Council. CHARTER AMENDMENT "B: " City Charter Sections 500, 501, 502, 5033 704 and 707 shall be amended to provide that the position of City Clerk shall be appointed by the City Admin- istrator subject to the approval of the City Council. CHARTER AMENDMENT "C : " City Charter Sections 500, 5013 502, 503 , 705 and 707 shall be amended to provide that the position of City Treasurer shall be appointed by the City Ad- ministrator subject to the approval of the City Council. SECTION 3 . That all ballots cast, including the absentee ballots cast, have been duly canvassed and counted as required by law, and the result of such count is hereinafter stated . That this City Council does hereby accept the canvass of the returns of said election, as made by the Registrar of Voters of the County of Orange, and certified by the Registrar of Voters of said county, in his Canvass and Statement of Result of Election, dated November 12, 1973, with a total count for all precincts established in the City of Huntington Beach, in- cluding all absentee ballots cast in said precincts, being as follows : PROPOSED CHARTER AMENDMENT "A" YES VOTES - 11,674 NO VOTES - 15,522 3. PROPOSED CHARTER AMENDMENT "B" YES VOTES 12, 007 NO VOTES - 15, 128 PROPOSED CHARTER AMENDMENT "C" YES VOTES 11, 506 NO VOTES - 15, 663 SECTION 4. That the votes of a majority of all the electors voting on Proposition "A" at said election were cast against the adoption of said Proposition "A, " and said Prop- osition "A" is hereby declared to be defeated. SECTION 5. That the votes of a majority of all the electors voting on Proposition "B" at said election were cast against the adoption of said Proposition "B, " and said Prop- osition "B" is hereby declared to be defeated. SECTION 6. That the votes of a majority of all the electors voting on Proposition "C" at said election were cast against the adoption of said Proposition "C, " ' and said Prop- osition "C" is hereby declared to be defeated.
