A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ESTABLISHING UNDERGROUND
UTILITY DISTRICT NO. 73-1
WHEREAS, by Resolution No. 3804, a public hearing was
called for January 7, 1974 at the hour of 7: 00 p.m. , or as
soon thereafter as the matter could be heard, in Council
Chambers of City Hall, Huntington Beach, California, to ascer-
tain whether the public necessity, health, safety, or welfare
requires the removal of poles , overhead wires and associated
overhead structures and the underground installation of wires
and facilities for supplying electric, communication, or simi-
lar or associated service within the right of way of Magnolia
Street from the south side of Atlanta Avenue to approximately
1000 feet northerly of the center line of Atlanta Avenue; and
Notice of such hearing has been given to all affected
property owners as shown on the last equalized assessment roll
and utilities concerned in the manner and for the time required
by law; and
Such hearing has been duly and regularly held, and all
persons interested have been given an opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Huntington Beach hereby finds and determines that
the public necessity, health, safety and welfare require the
removal of poles, overhead wires and associated structures, and
the underground installation of wires and facilities for sup-
plying electric, communication, or similar or associated serv-
ice within the right of way of Magnolia Street from the south
side of Atlanta Avenue to approximately 1000 feet northerly of
the center line of Atlanta Avenue, and such described area is
hereby established as Underground Utility District No. 73-1.

RESOLVED, FURTHER, that the City Council of the City of
Huntington Beach finds that:
(a) Such undergrounding will avoid or eliminate an un-
usually heavy concentration of overhead distribution facilities,
and
(b) Said street right of way is extensively used by the
general public and carries a heavy volume of vehicular traffic .
RESOLVED, FURTHER, that all poles , overhead wires and
associated overhead structures shall be removed and underground
installations made in said underground utility district within
the following times :
(a) Underground installation by utility companies and
property owners and reconnections not later than December 31,
1974.
(b) Removal of poles , overhead wires and other associated
overhead structures not later than December 31, 1974.
RESOLVED, FURTHER, that the City Clerk, within ten (10)
days after the adoption of this resolution, shall mail a copy
hereof and a copy of Article 975 of the Huntington Beach Ordi-
nance Code to affected property owners as such are shown on the
last equalized roll and to the affected utilities .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 7th
day of January, 1974.

members of the City Council of the City of Huntington Beach is seven;
that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
at a regular meeting thereof held on the 7th day
of January , 19 74 by the following vote:
