HomeMy WebLinkAboutCity Council - 3837 RESOLUTION NO . 3837 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF HUNTINGTON STREET AND DELAWARE STREET WHEREAS, on January 7, 1974, the City Council of the City of Huntington Beach duly adopted Resolution No. 3823 declaring its intention to vacate a portion of Huntington Street and Delaware Street in the City of Huntington Beach, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of Monday, February 4, 1974 at the hour of 7: 00 p .m. , or as soon there- after as the matter may be heard, in the Council Chambers in City Hall, Huntington Beach, California for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed vacation were posted con- spicuously along that portion of Huntington Street and Delaware Street proposed to be vacated, and such notices were posted not more than three hundred (300) feet apart and at least three (3 ) were posted. On February 4, 1974, at the hour of 7: 00 p.m. thereof in Council Chambers in City Hall, Huntington Beach, California, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or object- ing to the proposed vacation of a portion of Huntington Street and Delaware Street, at which time no objection was made to said vacation, and evidence was presented showing that the portion of Huntington Street and Delaware Street proposed to be vacated is not necessary for present and prospective public street and is not suitable for use or development as bicycle paths or routes . /er 1 . j . NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Part 3, Division 9 of the State of California Streets and Highways Code (Section 8300 et seq. ) , does resolve that the portion of Huntington Street and Delaware Street here- inafter set forth is not necessary for present or prospective public street purposes , and is not suitable for use or develop- ment as bicycle paths or routes, and it is hereby ORDERED that the following described portion of Huntington Street and Delaware Street in the City of Huntington Beach be and the same is hereby vacated; and said portion of Huntington Street and Delaware Street so vacated is described as follows : HUNTINGTON STREET (PARCEL 1) All that portion of Huntington Street, 60 . 00 feet wide, as same is shown on the map of Tract No . 7 , recorded in Book 9, Page 8 of Miscellaneous Maps , records of Orange County , California, described as follows : A strip of land of the uniform width of 30 . 00 feet, being the east 30 . 00 feet of said Huntington Street . The sidelines of said strip to be prolonged or shortened to terminate northerly in the westerly prolongation of the north line of Lot 1, Block C of said Tract No. 7 and to terminate southerly in the westerly prolongation of the south line of Lot 33 Block C of said Tract No . 7. RESERVING an easement and right of way for alley purposes over the south 10 . 00 feet, thereof. HUNTINGTON STREET (PARCEL 2) All that portion of Huntington Street, 60 . 00 feet wide, as same is shown on the map of Tract No . 37, recorded in Book 9, Page 34 of Miscellaneous Maps , records of Orange County , California, described as follows : A strip of land of the uniform width of 30 . 00 feet, being the West 30 . 00 feet of said Huntington Street . The sidelines of said strip to be prolonged or shortened to terminate northerly in the easterly prolongation of the north line of Lot 1 of said Tract No. 37 and to terminate southerly in the easterly prolongation of the south line of the north 132 . 00 feet of Lot 3 of said Tract No. 37. 2. DELAWARE STREET All that portion of Delaware Street, 60 . 00 feet wide, as same is shown on the map of Tract No. 7, recorded in Book 9 , Page 8 of Miscellaneous Maps , records of Orange County , California, described as follows : Beginning at the northeast corner of Lot 2, Block C of said Tract No. 7; thence, along the east line of said Lot 2 and the west line of said Delaware Street, South 0° 01 ' 22" west 21 . 60 feet to a point on a curve, concave southwesterly and having a radius of 32 . 00 feet, a radial bearing of said curve through said point bears north 18' 10' 43" east, said point being the True Point of Beginning; thence, through a central angle of 84' 30 ' 06" along the arc of said curve southeasterly and southerly 47.19 feet to the beginning of a compound curve, concave northwesterly and having a radius of 360 . 00 feet, a radial line through said point of compound curvature bears north 770 19' 11" west; thence, through a central angle of 5° 32' 15" along the are of said curve southwesterly 34 . 79 feet to the beginning of a reverse curve, con- cave southeasterly and having a rWdius of 440 . 00 feet, a radial line through said point of reverse curvature bears north 110 46' 56" west; thence, through a central angle of 5° 57 ' 23" along the arc of said curve south- westerly 45 .74 feet to a point of intersection with the before described east line of Lot 2; thence along said east line north 01 01 ' 22" east 115 . 06 feet to the True Point of Beginning. As to Parcel 1 and Parcel 2 of Huntington Street, the City hereby reserves and excepts from the vacation a permanent easement and right at any time, or from time to time, to con- struct, maintain, operate, replace, remove and renew water mains and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, and other convenient struc- tures , equipment and fixtures for the operation of water and incidental purposes , including access and the right to keep the property free from inflammable materials and wood growth and otherwise protect same from all hazards in, upon and over said Huntington Street and that portion proposed to be vacated. PASSED AND ADOPTED by the City Council of the City of 3 . Huntington Beach at a regular meeting thereof held on the 4th day of February, 1974 .
