HomeMy WebLinkAboutCity Council - 3868 RESOLUTION NO . 3868 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH OF INTENTION TO VACATE A STORM DRAIN EASEMENT OVER A PORTION OF LOT 28 OF TRACT NO . 6808 IN THE CITY OF HUNTINGTON BEACH The City Council of the City of Huntington Beach does hereby resolve as follows : SECTION 1 . Pursuant to Division 9 Part 3, Chapter 2 p of the Streets and Highways Code of the State of California (Sections 8320 et seq. ) , the City Council of the City of Huntington Beach hereby declares its intention to vacate a storm drain easement over Lot 28 of Tract No . 6808, described as follows : The Northerly 10 . 00 feet of Lot 28 of Tract 68o8, as shown on a map recorded in Book 295, pages 39 to 42, inclusive, of Miscellaneous Maps , Records of Orange County. SECTION 2 . The City Clerk is directed to maintain on file in the office of the City Clerk maps or plans showing the particulars of the proposed vacation of a storm drain easement over Lot 28 of Tract No . 6808 as hereinabove set forth, and reference is hereby made to said maps or plans for said particulars as to said proposed vacation. SECTION 3. The City Council does hereby fix May 6, 1974 at the hour of 7 : 00 P.M. , or as soon thereafter as the matter may be heard in Council Chambers in the City Hall, Huntington Beach, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. SECTION 4 . The City Clerk is directed to cause a copy of this resolution to be published in the Huntington Beach News, a k 1. newspaper of general circulation, printed and published in the City of Huntington Beach within fifteen (15) days of the passage of this resolution. SECTION 5 . The Street Superintendent is directed to post, or cause to be posted, notices of the easement vacation conspicuously along that storm drain easement proposed to be vacated at least ten (10 ) days before the date of the hearing. Such notices shall be posted not more than three hundred (300) feet apart, but at least three (3) shall be posted. Such notices shall state the passage of this resolution of intention and the time and place of hearing.
