A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH RECOMMENDING A COMPLETE
REVISION, REWRITE AND UPDATE OF DIVISION 9 OF
THE HUNTINGTON BEACH ORDINANCE CODE
WHEREAS, the Planning Commission has the responsibility for
acting upon planning and zoning matters as specified in the City
Charter, the Planning Act of the State of California, and pro-
visions of the local ordinances; and
The dynamic growth of the City, combined with the frequent
changes in zoning regulations and State zoning mandates, has
necessitated numerous code amendments, which over the years have
created internal uncertainty in Division 9 of the Huntington Beach
Ordinance Code, with periodic opinions by the City Attorney as to
the invalidity of certain provisions; and
Many provisions are archaic or contradictory and much of
Division 9 does not truly reflect the policy of the City Council;
and
Recent appellate court cases have modified many areas of
the law of zoning, thus rendering much of Division 9 legally
doubtful; and
The procedural provisions of Division 9 are inadequate and
clumsy; and
Division 9 in its present form is a difficult and unpredictable
device to administer zoning and planning matters;
The Planning Commission of the City of Huntington Beach has
requested that this Council adopt a resolution to recommend the
process to be followed,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach that a complete and comprehensive re-
vision, rewrite and update of Division 9 be undertaken as soon
as possible, and it shall be considered a high priority item in
order to facilitate the administration of the planning and zoning
laws of the City of Huntington Beach;
That by reason of staff limitations , this assignment should

be given to a qualified planning and zoning consultant firm by
contracts and
A sum of $25,000 has been allocated in the budget to
accomplish the assignment set forth hereinabove .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 17th
day of June, 1974 .
