RESOLUTION DETERMINING FEASIBILITY OF PROJECT,
WAIVING DEBT LIMITATION, AND OVERRULING PROTESTS
SUNSET HEIGHTS ASSESSMENT DISTRICT
ASSESSMENT DISTRICT NO. 7201
HUNTINGTON BEACH, CALIFORNIA
WHEREAS , a public hearing was duly and legally called and
held by the City Council of the City of Huntington Beach, State
of California, upon the Investigation Report of DONALD E. STEVENS ,
INC. , Engineer of Work, on August 5 , 1974 , at which time said report
was first summarized; and
WHEREAS , all protests made in writing or orally to said
proposed improvement were duly and legally considered; and
WHEREAS , said Engineer of Work has advised that said
protests , both oral and written, were not made by owners of more
than half of the area of the property proposed to be assessed for
said proposed work and improvement, and said City Council having
acquired jurisdiction to proceed herein:
NOW, THEREFORE , BE IT RESOLVED by the City Council of
the City of Huntington Beach , State of California, that all of said
protests , both oral and in writing, be and the same hereby are over-
ruled and denied.
BE IT FURTHER RESOLVED that said City Council hereby
finds from said Investigation Report, the information and opinion
furnished by said Engineer of Work, and its personal knowledge
of the land and improvements in this assessment district, that
said proposed project is feasible, that the public interest, con-
venience and necessity require said proposed work and improvement,
and that the lands to be assessed will be able to carry the
burden of the proposed assessments.

BE IT FURTHER RESOLVED that the limitations upon the
amount of assessments provided for in the Special Assessment In-
vestigation, Limitation and Majority Protest Act of 1931 , Division
4 of the Streets and Highways Code of the State of California, shall
be disregarded, both with respect to the limitations on the district
as a whole and as to the limitations on individual specific
assessments.
BE IT FURTHER RESOLVED that proceedings for said improve-
ment shall be taken under the Improvement Act of 1911 of the State
of California, Division 7 of the Streets and Highways Code, and that
improvement bonds shall be issued pursuant to the provisions of
said improvement act.
