HomeMy WebLinkAboutCity Council - 3930 RESOLUTION NO. 3930 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING AND DIRECTING THE MAYOR AND THE CITY CLERK TO EXECUTE CON- TRACT TO PARTICIPATE IN COUNTY-WIDE PROJECT FOR THE CONTROL OF DANGEROUS DRUGS (ORANGE COUNTY NARCOTIC INDEX GRANT) WHEREAS, by Resolution No. 3724, dated July 2, 1973, the City Council of the City of Huntington Beach agreed to deposit with the City of Santa Ana its pro rata share of the Narcotics Task Force Hard Cash Matching Funds; and The City Council of the City of Huntington Beach desires to continue its participation in this county-wide project for the control of dangerous drugs; and The City of Santa Ana is making application to continue this Federal grant with second year funding scheduled to begin on September 4, 1974, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that it does authorize and direct the Mayor and City Clerk, upon and after execution by the City of Santa Ana, to execute the contract, a copy of which is attached,.hereto and by reference made a part hereof, by which it agrees to deposit with the City of Santa Ana its pro rata share of the Narcotics Task Force Hard Cash Matching Funds in the sum of Five Hundred Twenty-two and 63/100ths Dollars ( $522 .63) , which sum shall be immediately returned to the City of Huntington Beach in the event grant of Federal funds is not made . C O N T R A C T 1 . t 1 This agreement by and between the City of Santa Ana, hereinafter 2 referred to as "Santa Ana" and the City of Huntington Beach, hereinafter 3 referred to as "Huntington Beach' on this day of 4 1974, is entered into for the following reasons: 5 A. Santa Ana and Huntington Beach have previously entered into an 6 informal agreement, about November 1970, under the terns of 7 which the parties agreed to participate with other cities 8 within Orange County and with various County of Orange agencies 9 to form a Narcotics Task Force. 10 B. In order to provide essential timely, expeditious, and 11 contimally available support to the Task pore* ■e■6sars and 12 interfae>e with other leer eaforeement agoacies in the area of 13 aareotic oriented iatelliEeace collectios, a mlysaties MW 14 distribution. A Narcotic Index Office be* been established say 15 will be located within the Santa Ana Police Department IM1141"S. 16 C. This contract will become operative, if and wbems the U. S. 17 Department of Justice Law Enforcement Assistance Administration 1.8 agrees to fund said program. 19 D. The application for U. S. Department of Justice Law Enforcement 20 Assistance Grant Action Funds which was the subject of Santa Ana 21 City Council Resolution #73-38 dated April 16, 1973 is hereby 22 incorporated by reference as part of this contract. 23 NOW, THEREFORE, in consideration of the benefits to be derived from ?4 establishment of the above referred to Narcotic Index Office, by each 25 party, the parties hereto agree as follows: 26 A. The Director of Finance for the City of Santa Ana, as Financial � Officer, , shall upon award of a Grant resulting from said. 28 application, simultaneously establish a special trust fund I 3 1 designated for Narcotics Task Force Hard Cash Matcbing Funds. 2 Said trust fund shall be in the amount of Five Thousand Three I ' 3 Hundred Thirty-Three Dollars ($5,333.00) and shall be disbursed 4 in a manner consistent with the grant conditions. Be shall also 5 establish a special trust fund to provide the required accountability 6 for the project. 4 7 B. Santa Ana Chief of Police, as Project Director shall order and 8 provide project direction and make payment on behalf of Ru*tiugton 9 Beach for services provided on aforesaid grant that ors required 10 in establishing the Narcotic Index Office. 11 C. Huntington Beach agrees to fulfill all duties as specified and 17 incorporated by reference application. 18 E. The Project Director and Financial Officer shall receive sal 19 disburse project funds through the above two trust accounts in 20 accordance with all legal requirements for the accounting, of 21 funds under the Omnibus Crime Control Act and Safe Streets Act 22 of 1968, and any amendments thereof. 23 F.
