HomeMy WebLinkAboutCity Council - 3953 RESOLUTION NO. 3953 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTOii BEACH ESTABLISHI14G UNDERGROUND UTILITY DISTRICT NO. 74-1 WHEREAS, by Resolution No. 3923, a public hearing was called for August 19 , 1974 at the hour of 7 :00 p.m. , or as soon thereafter as the matter could be heard, in Council Chambers of City Hall, Huntington Beach, California, to ascer- tain whether the public necessity, health, safety, or welfare requires the removal of poles , overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or simi- lar or associated service within the right-of-way of Goldenwest Street from the south side of Slater Avenue to the north side of Norma Drive and within the right-of-way of Warner Avenue from the east side of Goldenwest Street to the west side of Graham Street; and Notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the manner and for the time required by law; and Such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles , overhead wires and associated structures , and the underground installation of wires and facilities for sup- plying electric, communication, or similar or associated serv- ice within the right-of-way of Goldenwest Street from the south side of Slater Avenue to the north side of Norma Drive and er 1. within the right-of-way of Warner Avenue from the east side of Goldenwest Street to the west side of Graham Street , and such described area is hereby established as Underground Utility District iJo. 74-1. RESOLVED, FURTHER, that the City Council of the City of ' Huntington Beach finds that : (a) Such undergrounding will avoid or eliminate an un- usually heavy concentration of overhead distribution facilities , and (b ) Said street right-of-way is extensively used by the general public and carries a heavy volume of vehicular traffic . RESOLVED, FURTHER, that all poles , overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district within the following times : (a) Underground installation by utility companies and property owners and reconnections not later than June 30 , 1975 . (b) Removal of poles , overhead wires and other associated overhead structures not later than June 30, 1975 . RESOLVED, FURTHER, that the City Clerk, within ten ( 10) days after the adoption of this resolution, shall mail a copy hereof and a copy of Article 975 of the Huntington Beach Ordi- nance Code to affected property owners as such are shown on the last equalized roll and to the affected utilities .
