HomeMy WebLinkAboutCity Council - 4000 113 q RESOLUTION NO. 4000 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDER-ING THE VACATION OF A WALKWAY EASEMENT ON LOT 1 OF TRACT 5331 WHEREAS, on November 18, 1974, the City Council of the City of Huntington Beach duly adopted Resolution No. 3984 declaring its intention to vacate a walkway easement on Lot 1 of Tract 5331 in the city of Huntington Beach, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of Monday, December 16 , 1974 at the hour of 7: 00 p .m. , or as soon there- after as the matter may be heard, in the Council Chambers in the Civic Center, Huntington Beach, California, for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed vacation were posted conspicuously along said walkway easement on Lot 1 of Tract 5331, and such notices were posted not more than three hundred (300) feet apart and at least three ( 3) were posted. On December 16 , 1974 at the hour of 7: 00 p .m. thereof in the Council Chambers in the Civic Center, Huntington Beach, California, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of said walkway ease- ment on Lot l of Tract 5331, at which time no objection was made to said vacation, and evidence was presented showing that the said walkway easement on Lot 1 of Tract 5331 proposed to be vacated is not necessary for present and prospective public walkway and is not suitable for use or development as bicycle paths or routes . NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9, Page 3, Chapter 2 of the State of /k 1. 11/19/74 California Streets and Highways Code (Sections 8320 et seq. ) , does resolve that that walkway easement on Lot 1 of Tract 5331 hereinafter set forth is not necessary for present or prospective public purposes , and is not suitable for use or development as bicycle paths or routes, and it is hereby ORDERED that the following-described walkway easement on Lot 1 of Tract 5331 in the city of Huntington Beach be and the same is hereby vacated; and said walkway easement so vacated is described as follows : The South_ 10 .00 feet of Lot 1 of Tract 5331, as shown on a map recorded in Book 231, pages 15 through 17, inclusive, of Miscellaneous Maps , Records of Orange County.
