HomeMy WebLinkAboutCity Council - 4053 RESOLUTION NO. 4053 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH DECLARING ITS INTENTION TO VACATE A PORTION OF THE EAST SIDE OF GRAHAM STREET 660 FEET NORTH OF SLATER AVENUE The City Council of the City of Huntington Beach does resolve as follows : SECTION 1. A public hearing was held before the Planning Commission on March 18, 1975, at which time it was determined, pursuant to Government Code Section 65402, that the proposed vacation of a portion of the east side of Graham Street con- formed to the city ' s General Plan. SECTION 2 . Pursuant to Division 9 , Part 3, Chapter 2 of the Streets and Highways Code of the State of California (Sections 8320 et seq . ) , the City Council of the City of Huntington Beach hereby declares its intention to vacate a portion of the east side of Graham Street 660 feet north of Slater Avenue, described as follows : PARCEL 1 : Beginning at the southwest corner of Lot 1 of Tract 5331, as shown on a map re- corded in Book 231, pages 15 through 17 in- clusive of Miscellaneous Maps, records of Orange County; thence north 0°57123" west 93. 88 feet along the west line of said Lot 1 to a point , said point being the northwest corner of said Lot l; thence south 62°31 ' 37" west 44 . 70 feet along the northerly boundary line of said tract to a point on a line, said line being the west boundary line of said tract ; thence south 0057123" east 73. 00 feet along said westerly boundary to a point on a line, said line being the most southerly boundary line of said tract ; thence north 89025 ' 14" east 40 . 00 feet to the point of beginning. Excepting therefrom the west 33 . 00 feet . 1. JJOC :ahb PARCEL 2 : Beginning at the most southerly corner of Tract 5791, as shown on a map recorded in Book 236 , pages 20 through 23 inclusive of Mis- cellaneous Maps , records of Orange County; thence north 62°31 ' 37" east 58 . 65 feet along the southerly line of said tract to a point, said point being the southwest corner of Lot 52 of said tract; thence north 410331" west 122 . 00 feet along the west line of said Lot 52 to a point , said point being the northwest corner of said Lot 52; thence south 89102' 37" west along a line to a point on the west boundary line of said tract ; thence south 0057123" east along said west boundary line to the point of beginning. Excepting therefrom the west 33 . 00 feet . PARCEL 3 : Beginning at the northwest corner of Lot of Tract 5791, as shown on a map recorded in Book 236, pages 20 through 23 inclusive of Miscellaneous Maps, records of Orange County; thence north 88140147" west 6 . 50 feet along a line to a point on a nontangent curve, said curve being concave to the northwest and having a radius of 1007 . 00 feet ; thence southerly along said curve through a central angle of 2°09145" an arc distance of 38. 01 feet to a point of reverse curvature, a radial line through said point bears north 8603110211 west , said reverse curve being concave to the southeast and having a radius of 993 . 00 feet; thence southerly along said reverse curve through a central angle of 4026121" an arc distance of 76 . 94 feet to a point on a tangent line , said line being parallel with and distant 33 . 00 feet east of and measured at right angles from the west boundary of said tract ; thence south 0057123" east 57 . 20 feet along said tangent line to a point ; thence north 89002 ' 37" east along a line to the southwest corner of Lot 53 of said tract ; thence north 4003 ' 31" west 97 . 29 feet along the west line of said Lot 53 to a point; thence north 0057123" west 70 . 17 feet along the west lines of Lots 53 and 54 of said tract to the point of beginning. The city hereby reserves and excepts from the proposed vaca- tion of Parcel 1, as described above, a permanent slope easement and right at any time or from time to time to maintain said slope . The city also hereby reserves and excepts from the vacation 2 . of Parcels 2 and 3, as described above, a permanent slope and storm drain easement and right at any time or from time to time to construct, maintain, operate, replace, remove and renew storm drains and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be vacated. SECTION 3 . The City Clerk is directed to maintain on file in the office of the City Clerk maps or plans showing the particulars of the proposed vacation of a portion of the east side of Graham Street 660 feet north of Slater Avenue, and reference is hereby made to said maps or plans for said particu- lars as to said proposed vacation. SECTION 4 . The City Council does hereby fix May 5, 1975 at the hour of 7 : 00 p .m. , or as soon thereafter as the matter may be heard in Council_ Chambers in the Civic Center, Huntington Beach, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. SECTION 5. The City Clerk is directed to cause a copy of this resolution to be published in the Huntington Beach News , a newspaper of general circulation, printed and published in the city of Huntington Beach within fifteen (15) days of the passage of this resolution. SECTION 6 . The Street Superintendent is directed to post , or cause to be posted, notices of the proposed vacation con- spicuously along that portion of the east side of Graham Street 660 feet north of Slater Avenue at least ten (10) days before the date of the hearing. Such notices shall be posted not more than three hundred (300 ) feet apart , . but at least three (3) shall be posted. Such notices shall state the passage of this resolution of intention and the time and place of hearing.
