HomeMy WebLinkAboutCity Council - 4075 RESOLUTION NO. 4075 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH NOTIFYING THE ACTING SECRETARY OF THE FEDERAL INSURANCE ADMINISTRA- TION OF THE TOTAL UNACCEPTABILITY OF THE PROPOSED CHANGES TO THE NATIONAL FLOOD INSURANCE PROGRAM AS PRINTED IN THE MARCH 26, 1975 FEDERAL REGISTER WHEREAS, the Acting Secretary of the Federal Insurance Administration printed proposed amendments to the National Flood Insurance Program in the Federal Register of March 26, 1975, and requested comments by May 26, 1975; and The City of Huntington Beach is directly affected by said program and by the proposed changes which would constrict development of floodprone lands in Huntington Beach and guide construction away from flood hazard areas; and These changes would require the City to elevate any new development in accordance with any existing flood elevation data until official elevations are prepared by the Federal Insurance Administration, thereby forcing elevation of new development commencing with adoption of these proposed regula- tions; and These changes dictate that the Corps of Engineers ' flood proofing criteria must be used in nonresidential structures, thus eliminating local flexibility in developing this portion of the flood management plan; and Proposed regulations prohibiting fill in "coastal high" flood areas would preclude development in some special flood hazard areas other than on stilts or pilings; and These changes would require state approval of local flood plain management regulations and allow agencies other than the City to judge compliance with local ordinances; and /cs 1. 3E The proposed regulations could require upgrading of local drainage systems; and These proposed changes taken together would shorten the time available to the City to implement the Federal regulations , limit the amount of local initiative in formu- lating flood management regulations, and continue to dis- courage development of remaining vacant lands in the city, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Huntington Beach does hereby notify the Acting Secretary of the Federal Insurance Administration that the proposed changes to the National Flood Insurance Program as printed in the Federal Register on March 26, 1975 , are totally unacceptable and contrary to the long-range interests of the City and its residents , BE IT FURTHER RESOLVED that the City Council does hereby request the Congressional Representatives of Huntington Beach to introduce legislation amending the National Flood Insurance Act of 1968 to provide relief to already urbanized flood plains adversely affected by the Flood Insurance Program. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 5th day of May, 1975 .
