A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH STATING THE RESULT OF THE
CANVASS OF ELECTION RETURNS OF THE SPECIAL
ELECTION HELD MAY 27, 1975
WHEREAS, the City Council of the City of Huntington Beach
by Resolutions No . 4029 and 4030 , duly called and provided for
the holding of a special election in said city on May 27, 1975
for the purpose of submitting to the qualified voters of said
city the proposition to amend the Charter of the City of
Huntington Beach as set forth in said resolutions and herein-
after stated; and
Notice of said election was duly and regularly given in
time, form and manner as provided by law, and said election was
held on said date at the polling places designated in Resolution
No . 4083, passed and adopted by the City Council on April 21,
1975, and the votes cast thereat were canvassed and the returns
thereof made by the City Clerk of the City of Huntington Beach
at the time and in the manner and form provided by law; and
Said City Council has duly assembled at its usual place of
meeting to receive the certification of the returns of said
election as determined by the City Clerk, conducting said canvass
for, and by order of, the City Council,
NOW, THEREFORE, the City Council of the City of Huntington
Beach does hereby resolve, determine, and order as follows :
SECTION 1. That the special election for the purpose of
submitting to the voters of the City of Huntington Beach the
proposition hereinafter set forth was duly held on May 27, 1975,
and the votes cast at said election were duly and regularly
canvassed and the returns thereof made at the time and in the
form and manner required by law.

SECTION 2. The the proposition voted upon at said election
is as follows , to wit:
'Should Article XII of the Charter of the
'City of Huntington Beach be amended by
'adding thereto a new Section 1221 to read: ' r r
r "The City Council shall not levy a '
' tax on the transfer or conveyance of ' YES
' any interest in real property unless
' authorized by the affirmative votes of
' a majority of the electors voting on
' a proposition submitted to the elec-
tors to authorize such a tax at a gen-' r r
' eral or special election. Any ordi-
nance heretofore adopted by the City
' Council levying a tax on the transfer
' or conveyance of any interest in real ' NO
' property prior to the effective date r r r
' of this amendment shall be of no fur- ' ' '
' ther force and effect . "

SECTION 3. That the City Council has received the returns
of said election, as canvassed by the City Clerk at this Council' s
direction and on its behalf, and this Council finds that the
total number of votes cast in each of the respective election
precincts for and against the charter amendment proposition, the
total number of absentee votes cast for and against the proposition,
and the total number of votes cast in said city for such proposition
are as shown on Exhibit "A" attached hereto and made a part of
this resolution.
SECTION 4. That the votes of a majority of the qualified
electors voting on said proposition at said election were cast in
favor of the adoption of said proposition, and said proposition
is hereby declared to be carried.
SECTION 5. That the whole number of ballots cast in the
City of Huntington Beach at said special election, including all
absentee ballots was 18, 808 ballots .
SECTION 6 . The City Clerk is hereby directed to enter on
the records of the City Council a statement of the result of

said election as required by law.
SECTION 7. That the City Clerk shall attest and certify
to the passage and adoption of this resolution by a majority of
the votes of the members of the City Council of the City of
Huntington Beach.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 2nd
day of June, 1975.

EXHIBIT "A"
STATEMENT OF CITY CLERK
I, ALICIA M. WENTWORTH, the duly elected, qualified and
acting City Clerk of the City of Huntington Beach, and ex-
officio Clerk of the City Council of said city, do hereby
certify that I, in accordance with direction from said City
Council set forth in Resolution No . 3854, did conduct the
canvass of the returns of the Special Municipal Election held
in the City of Huntington Beach on May 27, 1975, submitting
the following to the qualified voters of said city:

I further certify that the absentee voters ' ballots have
been duly canvassed and counted, as required by law, and the
result of such count is hereinafter stated; that I have duly
canvassed the returns of said election and from said returns it
appears that the total number of votes cast in each of the
respective precincts established for said election, upon said
Charter Amendment Proposition, the total number of absentee
votes cast in each of the respective precincts established for
said election upon said proposition, and the number of votes
therein for said proposition, the total number of absentee votes
cast at said election for said proposition and the total number
of votes cast in said city for said proposition, are as follows,
to wit :

vote of more than a majority of all the members of said City Council
