A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH AUTHORIZING EXECUTION OF
AGREEMENT BETWEEN THE CITY OF HUNTINGTON
BEACH AND THE ORANGE COUNTY HOUSING AUTHORITY
WHEREAS, under the provisions of Section 8 of the United
States Housing Act of 1937, as amended, the United States of
America, acting through the Secretary of the Department of
Housing and Urban Development , is authorized to provide fi-
nancial assistance to local public housing agencies pursuant
to which such agencies may enter into contracts to make assis-
tance payments to owners of existing, new construction, or
substantial rehabilitation housing for the purpose of aiding
lower income families in obtaining a decent place to live with-
in their means; and
The Housing Authorities Law of the State of California,
particularly Section 34209 of the California Health and Safety
Code , prohibits the Housing Authority from operating within any
city unless the consent of the governing body of such city has
been obtained . and
The Orange County Housing Authority is a Housing Authority
subject to Section 34209 of the California Health and Safety Code;
and
Huntington Beach has determined that the services of the
Orange County Housing Authority are needed within the city,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach that an agreement permitting the Orange
County Housing Authority to operate within the city be approved.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 7th

an Agreement dated July 8, 19?5 authorizing the Orange County
Housing Authority to administer the United States Department of Housing
and Urban Development Section 8 Leased Housing Program within the City of
Huntington Beach

THIS AGREEMENT made and entered into this- 9"'Lheday of
�19_2�_by and between the CITY OF HUNTINGTON BEACH
hereinafter referred to as "CITY, " and the ORANGE COUNTY HOUSING
AUTHORITY, hereinafter referred to as "HOUSING AUTHORITY. "
WITNESSETH:
WHEREAS, under the provisions of SECTION 8 'of the United States
Housing Act of 1937, as amended, the United States of America,
acting through the Secretary of the Department of Housing and
Urban Development, is authorized to provide financial assistance
to Local Public Housing Agencies pursuant to which such Agencies
may enter into contracts to make assistance payments to owners of
existing, new construction, or substantial rehabilitation housing
for the purpose of aiding lower income families in obtaining a
decent place to live within their means;
WHEREAS, The Housing Authorities Law of the State of California, ,
particularly Section 34209 of the California Health and Safety Code,
prohibits the HOUSING AUTHORITY from operating within any City
unless the consent of the governing body of such City has been
obtained; and
WHEREAS, there is a lack of housing at affordable rents in .
said City for persons of low income.
NOW THEREFORE, the parties agree as follows:
SECTION 1. The HOUSING AUTHORITY is hereby authorized to
exercise its powers under the Housing Authorities Lana of the State
of California, specifically Section 34209 of the California Health
and Safety Code, including application of the provisions of
Section 8 of the United States Housing Act of 1937, as amended
within the CITY OF HUNTINGTON BEACH during the term of this
Agreement, and a copy of the CITY' s Resolution No. 10 5
authorizing this Agreement is attached hereto, "Exhibit A".
SECTION 2. The HOUSING AUTHORITY will, in submitting
applications on behalf of the CITY under the Section 8 of the
United States Housing Act of 1937, as amended, consult with
the CITY's representative on the AUTHORITY' s Advisory Committee
and any other representative designated by the Chief Executive
Officer of the CITY in determining the number, typee size, and
occupancy of units expected to be utilized in accordance with
provisions of the CITY' s Housing Assistance Plan, or equivalent
thereof.
SECTION 3. In applying the provisions and purposes of the
Section 8 of The United States Act of 1937, as amended, within
the CITY, the HOUSING AUTHORITY will be further guided by the
housing goals and provisions of the CITY, as expressed in its
Housing Assistance , Plan and other housing plans, to the extent
that such goals and provisions are consistent with the above
provisions and purposes.
SECTION 4. The term of this Agreement shall be 20 years provided
either party may, on at least 30 days written notice, declare that
the Agreement shall terminate upon expiration of all leases in the
CITY with regard to which the AUTHORITY is contractually committed
on the effective date of such notice, or with regard to which an
Agreement, or the equivalent thereof , with prospective owner of
new construction or substantial rehabilitation project has been
executed on the effective date of such notice. Said notice may
limit the right of the HOUSING AUTHORITY to enter into any housing
assistance payments contracts for additional dwelling units.
SECTION 5. This Agreement shall take effect on the date
last executed below.
SECTION 6. The City Clerk is directed to furnish the HOUSING
AUTHORITY and appropriate officers and agencies of the United
States. Government with such certified copies of this Agreement,

And resolutions ,or any other matters as may be necessary, or
required for their purposes.
SECTION 7. IN WITNESS WHEREOF, this Agreement is executed
by the parties hereto, by their respective officers thereunto duly
authorized, as follows:
