HomeMy WebLinkAboutCity Council - 4119 RESOLUTION NO. 4119 CITY OF HUNTINGTON BEACH RESOLUTION OF THE CITY COUNCIL CONFIRMING ASSESS- MENT, PURSUANT TO "IMPROVEMENT ACT OF 1911" , BE- ING DIVISION 7 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA ASSESSMENT DISTRICT NO. 7201 [SUNSET HEIGHTS] WHEREAS, there has been filed with the City Clerk, an assessment to represent the costs and expenses of the work and improvement done pursuant to proceedings had and taken under the provisions of the "Improvement Act of 1911" , being Division 7 of the Streets and Highways Code of the State of California, and pursuant to Resolution of Intention No. 3905; and, WHEREAS , the City Clerk has duly given notice in the man- ner provided by law of the filing of said assessment and of the time set for hearing; and, WHEREAS, said City Council is now satisfied as to the proper completion of the work and of the spreading of the assess- ment. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUN- CIL OF THE CITY OF HUNTINGTON BEACH, COUNTY OF ORANGE, CALIFORNIA, AS FOLLOWS : SECTION 1. That the above recitals are all true and correct. SECTION 2 . That the assessment and diagram, the pro- ceedings leading up to the same, and all acts and determinations of the officers and agents of the City of Huntington Beach, Cali- fornia, in relation to the work done and appurtenances and appurt- enant work in ASSESSMENT DISTRICT NO. 7201 (Sunset Heights) and to the said assessment, and the diagram attached thereto be, and the same are hereby ratified and confirmed, the work and improve- ment is accepted, and the Superintendent of Streets is hereby ordered and directed to attach to said assessment a warrant in the manner and form provided by law, said warrant bearing date of this Resolution, and is further ordered to deliver said warrant, diagram and assessment to the contractor, or its assignee, as the case may be, forthwith upon payment of the incidental expenses due thereon. SECTION 3. That the assessment roll, warrant and diagram shall be recorded in the Office of the Superintendent of Streets and immediately thereafter, the City Clerk shall file a copy of the assessment diagram in the Office of the County Re- corder and thereafter shall record in said Office of the County Recorder a Notice of Assessment all in the manner and form as pre- scribed by Section 3114 of the Streets and Highways Code of the State of California.
