RESOLUTION NO. 4151 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH OF INTENTION TO VACATE THE WEST SIDE OF MAGNOLIA STREET NORTH OF WARNER AVENUE The City Council of the City of Huntington Beach does hereby resolve as follows : SECTION 1. A public hearing was held before the Planning Commission on October 7, 1975, at which time it was determined pursuant to Government Code Section 65402, that the proposed vacation of the west side of Magnolia Street north of Warner Avenue conformed to the city' s General Plan. SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California (Sections 8320 et seq. ) , the City Council of the City of Huntington Beach hereby declares its intention to vacate the west side of Magnolia Street north of Warner Avenue, de- scribed as follows : Beginning at the southeast corner of Section 24, Township 5 South, Range 11 West, in the Rancho Las Bolsas, as shown on a map recorded in Book 51, page 13 of Miscellaneous Maps, Records of Orange County; thence north 011812211 east 516. 51 feet along the east line of said section as shown on a map recorded in Book 34, page 32 of Parcel Maps; thence north 89° 32138" west 50. 00 feet to a point, said point being the True Point of Beginning; thence continuing north 89032 ' 38"west a distance of 11 . 41 feet to a point on the west right of way line of Magnolia Street as shown on said parcel map; thence continuing north along the west right of way line of Magnolia Street north 2142127" west 246.86 feet to a point; thence south 89032 ' 38" east 24 . 38 feet to a point; thence south 0018122" west 246. 49 feet to the Point of Beginning. The City hereby reserves and excepts from the vacation a permanent easement and right at any time or from time to time, to construct, maintain, operate, replace, remove and renew er -1 . storm drains and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise to construct, maintain, operate, replace, remove, renew and enlarge free from inflammable materials and wood growth and otherwise protect same from all hazards in, upon and over said Magnolia Street and that portion proposed to be vacated. SECTION 3 . The City Clerk is directed to maintain on file in the office of the City Clerk maps or plans showing the particulars of the proposed vacation of the west side of Magnolia Street north of Warner Avenue, and reference is hereby made to said maps or plans for said particulars as to said proposed vacation. SECTION 4 . The City Council does hereby fix December 1, 1975 at the hour of 7 :00. p .m. , or as soon thereafter as the matter may be heard in Council Chambers in the Civic Center, Huntington Beach, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. SECTION 5. The City Clerk is directed to cause a copy of this resolution to be published in the Huntington Beach News , a newspaper of general circulation, printed and published in the City of Huntington Beach within fifteen (15 ) days of the passage of this resolution. SECTION 6. The Street Superintendent is directed to post, or cause to be posted, notices of vacation conspicuously along the west side of Magnolia Street north of Warner Avenue proposed to be vacated at least ten (10) days before the date of the hearing. Such notices shall be posted not more than three hundred (300) feet apart, but at least three (3) shall be posted. Such notices shall state the passage of this resolution of intention and the time and place of hearing. PASSED AND ADOPTED by the City Council of the City of 2.
