HomeMy WebLinkAboutCity Council - 4166 RESOLUTION NO. 4166 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH SETTING FORTH ADMINISTRATIVE RULES GOVERNING THE OPERATION OF BURGLAR ALARM BUSINESSES, SYSTEMS AND USERS WHEREAS , pursuant to Section 5 . 56 . 220 of the Huntington Beach Municipal Code, the City Council of the City of Huntington Beach does hereby adopt the following administra- tive rules to govern the operation of burglar alarm busi- nesses , systems and users : SECTION 1 . SILENT ALARMS TERMINATING AT THE POLICE DE- PARTMENT. SPECIFIC CONDITIONS. The installation of any alarm system in a manner which, when activated, would cause a signal or message to be sent to the police department ' s communication center shall comply with the following con- ditions : (a) The permittee shall provide for reasonable security of the signal on the private line. The Chief of Police may require that such line security be controlled by the tele- phone company or that such line security methods meet the specifications of the police alarm receiving device. (b) The key control device shall have an interlocking relay connection which, upon activation of the alarm system, locks in the activated mode and requires manual resting either key controlled or at least ten {10) feet from any alarm sens- ing device. (c ) The routine testing of alarms will be permitted on a monthly basis only. Additional testing will be permitted only upon just cause or after a service or repair of the system. The test shall include activation of the alarm system to the police department as approved by the Chief of Police or his authorized agent . If the subscriber has multiple alarm sensors , an internal test procedure to the master or key control unit must be provided. The subscriber or alarm business must notify the police department ' s communication center of the intended test. The police department shall 1. JG: ahb r dispatch a field officer to the location or otherwise obtain satisfactory identification from the subscriber that the test is authorized and assurance that full security is main- tained during the test . SECTION 2 . APPLICATION FOR ALARM TERMINATION AT POLICE DEPARTMENT. The Chief of Police shall have ultimate authority in approving applications for alarm systems terminating at the police department . The application shall be submitted on forms supplied by the Chief of Police. The application form shall require , but not be limited to, the following infor- mation: (a) From Subscriber (1) Name of subscriber (2) Address of subscriber (3) Business license number (if applicable) (4) Type of business or establishment (5) Telephone at location '(6) Owner's name, address and phone (7) Manager' s name, address and phone (8) List of persons to be contacted (name , address and phone ) (b ) From Alarm Company (1) Name of company (2) Address (3) Business phone (4) Twenty-four (24) hour emergency phone (5) Business license number (6) Police permit number SECTION 3. INSTALLATION AND MAINTENANCE COSTS. All costs and recurring charges incurred in the installation and maintenance of such silent alarm shall be borne by the per- son or firm requesting the privilege. (a) Installation Cost . A fee of One Hundred Dollars ($100 ) shall be submitted at the time of application to cover the cost of installation. This fee is nonrefundable unless the application is denied by the Chief of Police . (b) Telephone Lease Line Fees . The monthly telephone lease line and associated relays and audio monitoring equip- ment fees will be paid by the City of Huntington Beach which shall then collect the appropriate fees due the City of Huntington Beach from each individual alarm subscriber. 2 . (c) Recurring Administrative Fees . To cover the rou- tine administrative costs of operating the alarm system, the City of Huntington Beach shall collect a fee of Two Dollars ($2) per month from each subscriber to the police emergency alarm reporting system. (d) Payment of Fees and Charges . Upon receipt of a statement of fees and charges due to the City of Huntington Beach, each subscriber shall remit full payment within ten (10) days to the Finance Department of the City of Huntington Beach. SECTION 4. APPROVAL OF APPLICATION. The Chief of Police shall approve or deny the application and return written notice within fourteen (14) days of the date the application was received by the police department. In considering the application, the Chief of Police shall give priority to busi- ness establishments and other locations constituting a major public hazard. The applications for residential alarm sys- tems shall be considered on an individual basis where an actual need for direct police termination is justified. (a) Probationary Status and Suspension of Direct Police Termination. The Chief of Police is hereby authorized to place on probation or suspend the police termination of an alarm system issued under these regulations . (b ) Hearing. Such probationary status or suspension may be invoked after a hearing by the Chief of Police upon giving five (5) days prior written notice of the time, place and nature of the hearing to the subscriber by personal de- livery or by certified mail addressed to the subscriber' s address as shown on the application or in the latest written revision of such address filed by the subscriber with the Chief of Police . (c) Probationary Status . After the appropriate hear- ing, the Chief of Police may invoke probationary status upon the subscriber for a period not to exceed six (6) months . During the time of probation, a complete record of all alarm transactions shall be maintained. Within fourteen (14) days after the probationary period, the Chief of Police shall re- view the subscriber's record and may request another hearing if the violations continued to occur during the probationary period. (d) Suspension from Direct Police Termination. After the appropriate hearing, the Chief of Police may revoke di- rect termination to the police department . Notice shall be 3. made to both the subscriber and the subscriber' s alarm busi— ness . The direct termination shall remain in effect for a maximum of thirty (30) days to allow sufficient time for the conversion of the termination to an intermediary. SECTION 5. DISCONNECTION OF DEFECTIVE EQUIPMENT. In addition to any other remedy provided by law, the Chief of Police, or his authorized agent, may disconnect a defective or malfunctioning alarm device without prior notice .
