A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH ORDERING THE VACATION OF
THE WEST SIDE OF MAGNOLIA STREET NORTH OF
WARNER AVENUE
WHEREAS on November 1 the City Council of the City

of Huntington Beach duly adopted Resolution No. 4151 declaring
its intention to vacate the west side of Magnolia Street north
of Warner Avenue, and referring to maps or plans on file in
the office of the City Clerk for particulars as to the pro-
posed vacation; and
Said resolution fixed the time and place of December 1 ,
1975, at the hour of 7: 00 p.m. , or as soon thereafter as the
matter may be heard, in the Council Chambers in the Civic Center,
Huntington Beach, California, for hearing all persons interested
in or objecting to the proposed vacation, which time was not
less than fifteen (15) days from the passage of said resolution.
Notices of the proposed vacation were posted conspicuously
along said portion of the west side of Magnolia Street north
of Warner Avenue, and such notices were posted not more
than three hundred (300) feet apart and at least three (3)
were posted.
On December 8 , 1975, at the hour of 7: 00 p .m. , thereof in
the Council Chambers in the Civic Center, Huntington Beach,
California, the City Council of the City of Huntington Beach
did convene for the purpose of hearing all persons interested
in or objecting to the proposed vacation of the west side of
Magnolia Street north of Warner Avenue, at which time no
objection was made to said vacation, and evidence was presented
showing that the said west side of Magnolia Street north of
Warner Avenue proposed to be vacated is not necessary for
present and prospective public walkway or is not suitable for
use or development as bicycle paths or routes .

NOW, THEREFORE, the City Council of the City of Huntington
Beach, pursuant to Division 9 , Page 3, Chapter 2 of the State
of California Streets and Highways Code (Sections 8320 et
seq. ) , does resolve that that portion of the west side of
Magnolia Street north of Warner Avenue hereinafter set forth
is not necessary for present or prospective public purposes ,
and is not suitable for use or development as bicycle paths or
routes , and it is hereby
ORDERED that the following-described portion of the west
side of Magnolia Street north of Warner Avenue be and the same
is hereby vacated; and said portion of the west side of Magnolia
Street north of Warner Avenue so vacated is described as
follows :
Beginning at the southeast corner of Section 24,
Township 5 South, Range 11 West, in the Rancho
Las Bolsas , as shown on a map recorded in Book 51,
page 13 of Miscellaneous Maps , Records of Orange
County; thence north 0013122" east 516 . 51 feet
along the east line of said section as shown on
a map recorded in Book 34, page 32 of Parcel Maps ;
thence north 89032 ' 38" west 50 . 00 feet to a point ,
said point being the True Point of Beginning; thence
continuing north 89032 ' 38" west a distance of 11. 41
feet to a point on the west right of way line of
Magnolia Street as shown on said parcel map; thence
continuing north along the west right of way line
of Magnolia Street north 21142127" west 246 . 86 feet
to a point; thence south 89032 ' 38" east 24 . 38 feet
to a point; thence south 0018122" west 246 . 49 feet
to the Point of Beginning.
The City hereby reserves and excepts from the vacation
a permanent easement and right at any time or from time to time,
to construct , maintain, operate, replace, remove and renew
storm drains and appurtenant structures in, upon, over and
across such street or any portion thereof proposed to be vacated
and pursuant to any existing franchises or renewals thereof, or
otherwise to construct, maintain, operate, replace, remove,
renew and enlarge free from inflammable materials and wood
growth and otherwise protect same from all hazards in, upon
and over said west side of Magnolia Street north of Warner Avenue
proposed to be vacated.

I, ALICIA M. WENTWORTH, the duly elected, qualified City
Clerk of the City of Huntington Beach, and ex-officio Clerk of the
City Council of said City, do hereby certify that the whole number of
members of the City Council of the City of Huntington Beach is seven;
that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
at a regular adjourned meeting thereof held on the 8th day
Of December 19 75 by the following vote:
