HomeMy WebLinkAboutCity Council - 4182 RESOLUTION NO. 4182 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH GIVING NOTICE TO THE STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR ASSUMPTION OF RESPONSIBILITY FOR LABOR CAMP EMPLOYEE HOUSING CODE, ESTABLISHING FEES THEREFOR, AND SPECIFYING THE ORANGE COUNTY HEALTH DEPARTMENT AS THE ENFORCING AGENCY WHEREAS, California Labor Code Section 2640(b) authorizes cities to assume the responsibility for the enforcement of the Employee Housing Act (commencing with California Labor Code Section 2610) upon written notice to the Department of Housing and Community Development, subject to approval by said department for such assumption; and California Labor Code Section 2640(c ) authorizes such cities to establish a schedule of fees by ordinance for the operation of labor camps not to exceed that which is established by the . Commission of Housing and Community Development; and The County of Orange has assumed responsibility for the enforcement of the Employee Housing Act governing the inspection of labor camps within the unincorporated area of Orange County, and desires to provide this service for all cities within Orange County which contain a labor camp, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Huntington Beach that : 1. Effective February 2, 1976, the City of Huntington Beach shall assume the responsibility for the enforcement of the provisions of the California Employee Housing Act relative to all labor camps within this City subject to the approval of the California Department of Housing and Community Development . 2. The City of Huntington Beach shall establish a schedule of fees by ordinance for the operation of such labor camps not to exceed that which is established by the Commission of Housing and Community Development . Effective February 2, 1976, the City of Huntington Beach designates the Orange County Health Department as the enforce- ment agency for the Employee Housing Act relative to labor camps within this City. 4 . This action is taken pursuant to Section 2640 of the California Labor Code and Title 25, Section 2012 of the California Administrative Code. 5. Resolution No. 4041 is hereby repealed.
