HomeMy WebLinkAboutCity Council - 4218 RESOLUTION NO. 4218 A RESOLUTION OF THE CITY COU14CIL OF THE CITY OF HUNTINGTON BEACH OF INTENTION TO VACATE A PORTION OF GRAHAM STREET, SOUTH OF McFADDEN AVENUE The City Council of the City of Huntington Beach does hereby resolve as follows : SECTION 1. A public hearing was held before the Planning Commission on February 17, 1976, at which time it was determined pursuant to Government Code Section 65402, that the proposed vacation of 15 . 50 feet of right-of-way on the west side of Graham Street, South of McFadden Avenue, conformed to the city 's General Plan. SECTION 2 . Pursuant to Division 9 , Part 3 , Chapter 2 of the Streets and Highways Code of the State of California (Sections 8320 et seq. ) , the City Council of the City of Huntington Beach hereby declares its intention to vacate a portion of Graham Street, South of McFadden Avenue, described as follows : Those portions of the Southwest One-Quarter of the Southeast One-Quarter of Section No . 16, Township 5 South, Range 11 West , in the Rancho La Bolsa Chica, as shown on a map recorded in Book 51, Page 13, of Miscellaneous Maps, Records of Orange County , State of California, de- scribed as follows : Parcel No . 1 Beginning at the Southeast corner of Lot 5, Tract No. 8327 as shown on a map recorded in Book 337, Pages 4 and 5 of said Miscellaneous Maps ; Thence along the South line of said Tract 8327, South 8903912111 West 15. 50 feet to a point on the West line of Graham Street as described in a grant of easement recorded in Book 6678, Page 922 of the Official Records of said County; er 1. Thence along said West line South 0040 ' 30" East 185.97 feet to a point on a non-tangent curve concave Northwesterly and having a radius of 32. 00 feet, a radial to last said point bears South 31043 ' 05" East; Thence Northwesterly along said curve through a central angle of 58057125" an arc length of 32.93 feet to a tangent line; Thence along said tangent line North 0040 ' 30" West 158. 47 feet to the Point of Beginning; Parcel No. 2 Beginning at a point on said West line of Graham Street, distant thereon 240 .13 feet measured South 0040 ' 30" East from said South line of Tract No . 8327; Thence along said West line South 0040r30" East 361. 84 feet to a point on anon-tangent curve concave Northwesterly and having a radius of 32 .00 feet , a radial to last said point bears South 31043' 05" East; Thence Northeasterly along last said curve through a central angle of 58053 ' 50" an arc length of 32 . 89 feet to a point of compound curve with a curve concave Westerly and having a radius of 3393.00 feet , a radial to last said point bears North 89023'05" East; Thence Northerly along last said curve through a central angle of 0003' 5511' an arc length of 3. 54 feet to a tangent line; Thence along last said tangent line North 0040 ' 30" West 303. 50 feet to the beginning of a tangent curve concave Southwesterly and having a radius of 32 .00 feet; Thence Northwesterly along last said curve through a. central angle of 58057 ' 54" an arc length of 32 .93 feet to a point to which a radial bears North 300 21' 36" East and the Point of Beginning; Parcel No. 3 Beginning at a point on said West line of Graham Street , distant thereon 657 . 35 feet measured South 0040 ' 30" East from said South line of Tract No. 8327; 2. All of the above described parcels being subject to all easements of record, if any. All as shown on a plat attached hereto and made a part hereof. SECTION 3 . The City Clerk is directed to maintain on file in the office of the City Clerk maps or plans showing the particulars of the proposed vacation of a portion of Graham Street , South of McFadden Avenue, and reference is hereby made to said maps or plans for said particulars as to said proposed vacation. SECTION 4 . The City Council does hereby fix May 3, 1976 at the hour of 7: 00 p.m. , or as soon thereafter as the matter may be heard in Council Chambers in the Civic Center, Huntington Beach, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. SECTION 5 . The City Clerk is directed to cause a copy of this resolution to be published in the Huntington Beach News , a newspaper of general circulation, printed and published in the City of Huntington Beach within fifteen (15) days of the passage of this resolution. 3• SECTION 6 . The Street Superintendent is directed to post, or cause to be posted, notices of vacation conspicuously along that portion of Graham Street, South of McFadden, proposed to be vacated at least ten (10) days before the date of the hearing. Such notices shall be posted not more than three hundred ( 300 ) feet apart , but at least three (3) shall be posted. Such notices shall state the passage of this resolution of intention and the time and place of hearing. PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 5th day of April, 1976 .
