HomeMy WebLinkAboutCity Council - 4370 RESOLUTION NO. 4370 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNT IN N GTO BEACH STATING THE RESULT OF THE CANVASS OF ELECTION RETURNS OF THE SPECIAL ELECTION HELD NOVEMBER 2, 1976 WHEREAS, the City Council of the City of Huntington Beach by Resolution No . 4294 duly called and provided for the holding of a special election in said city on November 21 1976 for the purpose of submitting to the qualified voters of said city the propositions set forth in said resolution and hereinafter stated; and The City Council of the City of Huntington Beach did request the Board of Supervisors of the County of Orange, California, to include said special election for the City of Huntington Beach with an election being held by the County of Orange for the United States, and the State of California; and Said Board of Supervisors did consent to the combining of the Huntington Beach special city election with the general election being held by the County of Orange on November 2 , 1976; and Notice of said election was duly and regularly given in time, form and manner as provided bylaw, and said election was duly held on said date at the polling places designated by said County of Orange; and The County Clerk of the County of Orange did on November 30 , 1976 issue a certification of the statement of vote for the City of Huntington Beach special municipal election consolidated with the general election held November 2, 1976, and that the votes cast in the special election of the City of Huntington Beach as combined with the general election held by the County of Orange are as follows : 1 . DPB: cs PROPOSITION "M" Shall the City Charter be amended to require the affirmative vote of three-fourths (3/4) of the total members of the City Council to enact any measure levying any tax or fee? YES VOTES : 42, 915 NO VOTES: 13, 902 PROPOSITION 'IN" Shall the City Charter be amended to require the affirmative vote of five ( 5) members of the City Council (rather than the present requirement of four (4) ) to enact any tax or revenue raising measure, but keeping the requirement of four (4) affirmative votes to enact any nonrevenue raising fee or charge? YES VOTES : 36 ,772 NO VOTES: 17,944 NOW, THEREFORE, the City Council of the City of Huntington Beach does hereby resolve, determine and order as follows : SECTION 1 . That the special election for the purpose of submitting to the voters of the City of Huntington Beach the propositions hereinafter set forth was duly held on November 2, 1976, and the votes cast at said election were duly and regularly canvassed, and the returns thereof made at the time and in the form and manner required by law. SECTION 2 . That the propositions voted upon at said election were numbered "M" and "N" and were as follows , to wit : PROPOSITION "M" Shall the City Charter be amended to require the affirmative vote of three-fourths (3/4) of the total members of the City Council to enact any measure levying any tax or fee? PROPOSITION "N" Shall the City Charter be amended to require the affirmative vote of five (5) members of the City 2 . Council (rather than the present requirement of four (4) ) to enact any tax or revenue raising measure, but keeping the requirement of four (4) affirmative votes to enact any nonrevenue raising fee or charge? SECTION 3 . That all ballots cast, including the absentee ballots , have been duly canvassed and counted as required by law, and the result of such count is hereinafter stated . That this City Council does hereby accept the canvass of the returns of said election, as made by the County Clerk of the County of Orange , and certified by the County Clerk of said County in his letter dated November 30, 1976 with a total count for all precincts established in the City of Huntington Beach, including all absentee ballots cast in said precincts, being as follows : PROPOSITION "M" YES VOTES : 42,915 NO VOTES: 13,902 PROPOSITION "N" YES VOTES: 36,772 NO VOTES : 17 ,944 SECTION 4 . That the votes of a majority of all the voters voting on Proposition "M" at said election were cast for the adoption of said Proposition "M" and said Proposition "M" is hereby declared to be adopted. SECTION 5. That the votes of a majority of all the voters voting on Proposition "N" at said election were cast for the adoption of said Proposition "N" and said Proposition "N" is hereby declared to be adopted. SECTION 6 . That parts of Proposition "M" conflict with parts of Proposition "N" and that pursuant to subsection (j ) of Section 8 of Article 11 of the Constitution of the State of California, Proposition "M," having received the largest number of votes , shall control as to all matters in conflict . 3 . 4 PASSED AND ADOPTED by the City Council of the City of Huntington Beach at a regular meeting thereof held on the 6th day of December 1976 . Council of the City of Huntington Beach is seven; that the foregoing resolution was passed and adopted by the affirmative vote of more than a majority of all the members of said City Council at a regular meeting thereof held on the 6th day of December 1976 , by the following vote: AYES: Councilmen: Bartlett, Pattinson, Coen, Siebert, Shenkman, Wieder NOES: Councilmen: None ABSENT: Councilmen: Gibbs City Clerk and ex-officio Clerk of the City Council of the City of Huntington Beach, California
