HomeMy WebLinkAboutCity Council - 4398 RESOLUTION NO. 4398 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH REQUESTING THE CALIFORNIA COASTAL COMMISSION TO POSTPONE ACTION UPON DRAFT REGULATIONS FOR COASTAL COMMISSIONS AND TO CONSIDER SUGGESTED MODIFICATIONS TO PROCEDURAL MATTERS RELATED TO THE CALIFORNIA COASTAL ACT OF 1976 WHEREAS, in recognition of the California Coastal Com- mission's January 12, 1977 tentative agenda to consider and possibly decide upon organizational regulations and emergency regulations for processing of development permit applications, vested right claims, exclusions from permit requirements from the Coastal Act, and the issuance of permits by local govern- ments; and Such draft regulations for coastal commissions, if adopted in their present form, would result in a cumbersome administra- tive structure for local agencies; and By considering such amendments to Chapter 7 of the guide- lines (coastal development - permits issued by local government and other public agencies) as suggested by the City of Los Angeles (Attachment A) , coastal cities may be able to process Coastal Development Permits in a more efficient manner; and By deferring action on portions of the draft regulations concerning local agencies, state and coastal cities repre- sentatives will be afforded an opportunity to meet and confer upon the guidelines in an effort to further refine the document; and The City is desirous of conducting similar review sessions with the State regarding interpretive guidelines to assist local governments and others in determining how the policies of the Coastal Act shall be applied in the coastal zone prior to certification of local coastal programs prior to the adoption of such interpretive guidelines by the Coastal Commission, JOC ;er 1, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Huntington Beach that it hereby requests the California Coastal Commission to defer action upon Chapters 6 and 7 of the draft regulations for Coastal Commissions and the interpretive guidelines for a period of approximately two weeks to allow further refinement thereof. i, BE IT FURTHER RESOLVED, by this resolution, that the City of Huntington Beach hereby endorses the suggested modifications to Chapter 7 of the guidelines for Coastal Commissions prepared by the City of Los Angeles and exhibited on Attachment A hereof as a viable alternative to a portion of the draft regulations as they now exist . BE IT FURTHER RESOLVED, by this resolution that the City of Huntington Beach urges the California Coastal Commission to take action as expeditiously as possible upon receipt of the concerted efforts of state and coastal cities representatives regarding the suggested modifications to the draft regulations and the interpretive guidelines in order to avoid a prolonged involun— tary moratorium which presently is in existence as pending coastal development matters must await these decisions. Local Government Option. After-fuiftihng-flTe-requiremean of-SecAion -1-2-7-22: The local government shall, if it wishes to exercise the option provided in Public Resources Code Section 30600(b), adopt the resolution required by Pubic Resources Code Section 30620.5(b) for the entire area of its jurisdiction within the coastal zone. The program shall become effective on the 10th working day after the date of adoption of the resolution. Section 12723. Public Notice of Local Option Resolution. The Local, govern- ment shall notify the regional commission, the commission and all contiguous local governments within the coastal zone of the adoption of the resolution provided for in Section 12723 and shall publish the resolution and a-au unary -of-the--permit-program in the same manner it would publish a notice as a proposed general plan amendment; provided, however, that such _ notice shall also be published in the newspaper with the widest circulation in the portion of the local government jurisdiction lying within the coastal ' zone. ; ,> Section 12724. Coastal Development Fees. Coastal Development Permit '{ q Section 12730. issuance of Permit. The permit issued by the local government shall become final unless a valid appeal is filed with the regional commission on or before the 20th working day following receipt by the regional commission of the notice specified in Public Resources Code 30620. 5(c). Each local coastal development permit shall contain a state- ment that the permit shall not become effective until 20 working days have ' elapsed following the proper receipt by the executive director of the regional commission of the notice of permit issuance pursuant to Section 12741. i a . Article 4. Coastal Commission Review of Local Cokstal 15evelopmeniPermit Section 12740. Notice by Local Government. Section 12742, Notice bX *Executive Director. (a) Within 7 ryorking-days of receipt of the notice of permit issuance, the executive director of the regional commmission shall post a description of the development, on a form prescribed by the commission, at a conspicuous location in the office of the regional commission. (b) Within 7 working days of receipt of the notice of permit issuance, the executive director of the regional commission shall forward to the members of the regional commission and the commis- sion a description of the development, on a form prescribed by the executive director of the commission, in a manner reasonably calculated to allow tune w for review of the development and filfnb of appeals, Section 127453. x ili:-ig of Appeal. An appeal of a local i overnment's'- issuance of a coastal development permit may be filed by any, person qualified tinder Public Resources Code Section 30602(a). The appeal must be filed on the form prescribed by the executive director of the commission and received in the regional coramis:3ion office before or on the 20th working day after receipt of the notice of permit issuance by the regional commission. Section 12744. Effect of Apoeal°to the Regional Con=ission, Upon receipt in the regional commission office of a timely appeal by a qualified appellant = the executive director of the regional commission shall notify the permit applicant and the affected local government that the operation and effect of the coal--al development permit has been stayed pending action on the appeal as required by Section 30623 of the Public Resources Code. r Aim Res.
