A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
HUNTINGTON BEACH REQUESTING THE COUNTY OF ORANGE
TO UNDERTAKE THE DEFENSE OF THE CITY IN THE
MATTER OF J. C. PENNEY COMPANY, INC. VS. COUNTY
OF ORANGE, ET AL.
WHEREAS, J . C . Penney Company, Inc . has brought suit against
, the County of Orange, and the cities of Buena Park, Newport Beach,
Santa Ana, Huntington Beach, Orange, Garden Grove, Fullerton, and
Costa Mesa for property taxes collected by the County on behalf
of said cities, which taxes were paid under protest by J . C . Penney
Company, Inc . , and
The provisions of Revenue and Taxation Code Section 5138
provide that when such a suit is filed, a city may call upon the
County to undertake the defense of the action,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Huntington Beach hereby requests the County of Orange to
undertake the defense of the City of Huntington Beach in the matter
of J. C . Penney Company, Inc . v. County of Orange, et al, Orange
County Superior Court Case No . 242374 .
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach at a regular meeting thereof held on the 17th day
of January, 1977 .

City Council of said City, do hereby certify that ,the whole number of
members of the City Council of the City of Huntington Beach is seven;
that the foregoing resolution was passed and adopted by the affirmative
vote of more than a majority of all the members of said City Council
at a regular meeting thereof held on the 17th day
of January , 19 77 , by the following vote:
