HomeMy WebLinkAboutCity Council - 4408 RESOLUTION NO. 4408 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH OF INTENTION TO VACATE A PORTION OF THE WEST SIDE OF GRAHAM STREET AT SLATER AVENUE The City Council of the City of Huntington Beach does hereby resolve as follows :. SECTION 1. A public meeting was held before the Planning Commission on July 27, 1976, at which time it was determined pursuant to Government Code Section 65402, that the proposed vacation of a portion of the west side of Graham Street at Slater Avenue conformed to the city' s General Plan. SECTION 2. Pursuant to Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California (Sections 8320 et seq. ) , the City Council of the City of Huntington Beach hereby declares its intention to vacate a portion of the west side of Graham Street at Slater Avenue, described as follows : In the city of Huntington Beach, county of Orange, state of California, being those portions of Graham Street as shown on map of Tract No. 8630, recorded in Book 382, pages 7 through 10 of Miscellaneous Maps, in the office of the Count Recorder of said p � y County, more specifically described as follows : Parcel 1: Beginning at the most easterly corner of Lot 5 of said Tract No. 8630, said corner being a point in a curve, concave southwesterly and having a radius of 28. 00 feet, a radial line of said curve from said point bears south 36003 '33" west; thence along the boundary of said Lot 5 by the following courses : northwesterly along said curve through a central angle of 20041' 09" an arc length of 10 .11 feet to a point to which a radial line of said curve bears JOC:cs 1. north 15°22124" east; thence along the prolongation of said radial line, north 15122124" east 4. 00 feet to a point in a nontangent curve, concave southerly and having a radius of 32.00 feet, a radial line of said curve from said point bears south 15122124" west; thence westerly along said curve through a central angle of 14048124" an arc length of 8 . 27 feet to a point to which a radial line of said curve bears north 0'34100" east ; thence along the prolonga- tion of said radial line, north 0034, 0011 east 40. 00 feet to the most northeasterly corner of said Lot 5; thence leaving said boundary, along the prolongation of the northerly line of Lot 5, south 89126100" east 15 .63 feet; thence south 0034 ,00" west 4.00 feet to a point in a nontangent curve, concave southwesterly and having a radius of 12.00 feet, a radial line of said curve from said point bears south 0034,00" west; thence southeasterly along said curve through a central angle of 89036' 4g" an arc length of 18. 77 feet to a point to which a radial line of said curve bears south 89049tll" east; thence along the prolonga- tion of said radial line, south 89049111" east 4 .00 feet to a line parallel with and 40. 00 feet westerly of the centerline of said Graham Street; thence along said parallel line, south 0010 , 49" west 21.40 feet to the prolongation of the southeasterly line of said Lot 5; thence along said prolongation, south 53001'15" west 19. 56 feet to the point of beginning. Parcel 2 : Beginning at the most northerly corner of Lot 4 of said Tract No. 8630, said corner being a point in a curve, concave southwesterly and having a radius of 28. 00 feet, a radial line of said curve from said point bears south 36003' 33" west; thence along the boundary of said Lot 4 by the following courses : southeasterly along said curve through a central angle of 39°18'52" an are length of 19. 21 feet to a point to which a radial line of said curve bears north 75122' 25" east ; thence along the prolongation of said radial line, north 75022125" east 4. 00 feet to a point in a nontangent curve, concave westerly and having a radius of 32 . 00 feet , a radial line of said curve from said point bears south 72122125" west; thence southerly along said curve through a central angle of 14148124" an arc length of 8. 27 feet to a point of tangency with a line parallel with and 40 .00 feet westerly of the centerline of Graham Street; thence leaving said boundary, along said parallel line, north 0010 ,49" east 34 .50 feet 2. to the prolongation of the northwesterly line of said Lot 4; thence along said prolongation, south 53'01'15" west 19. 56 feet to the point of beginning. The City hereby reserves and excepts from the vacation a permanent easement and right at any time or from time to time, to construct, maintain, operate, replace, remove and renew storm drains and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise to construct , maintain, operate, replace, remove, renew and enlarge free from inflammable materials and wood growth and otherwise protect same from all hazards in, upon and over said portion of Graham Street proposed to be vacated. SECTION 3 . The City Clerk is directed to maintain on file in the office of the City Clerk maps or plans showing the particulars of the proposed vacation of a portion of the west side of Graham Street at Slater Avenue, and reference is hereby made to said maps or plans for said particulars as to said proposed vacation. SECTION 4. The City Council does hereby fix PZarch 7 ,' 1977 at the hour of 7:30 p .m. , or as soon thereafter as the matter may be heard in Council Chambers in the Civic Center, Huntington Beach, as the time and place for hearing all persons interested in or objecting to the proposed vacation, which time is not less than fifteen (15) days from the passage of this resolution. SECTION 5. The City Clerk is directed to cause a copy of this resolution to be published in the Huntington Beach News, a newspaper of general circulation, printed and published in the City of Huntington Beach within fifteen (15) days of the passage of this resolution.
