A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF HUNTINGTON BEACH AUTHORIZING CERTAIN PUBLIC
WORKS PROJECTS TO BE LET WITHOUT ADVERTISING
FOR BIDS DUE TO URGENT NECESSITY FOR THE
PRESERVATION OF LIFE, HEALTH OR PROPERTY
WHEREAS, the City Charter, Section 1211 provides that
public works contracts may be let and purchases made without
advertising for bids if such work shall be deemed by the City
Council to be of urgent necessity for preservation of life,
health or property, and shall be authorized by the affirmative
vote of at least two-thirds of the total members of the City
Council; and
The Director of Public Works has declared that there is
certain street work to be done on Newland Street . The city
work is along a three hundred twenty lineal foot frontage of
a park. A developer, La Cuesta, of an adjacent tract will be
widening Newland Street to include curb, gutter and sidewalk
work both north and south of the city work. If the street work
is not accomplished at the time of the widening of Newland
Street north and south of the city property, a traffic and
drainage obstruction will be created and will cause a hazard to
persons and property. The cost of street work if performed by
La Cuesta of Huntington Beach will be Eleven Thousand Eight
Hundred Dollars ( $11 ,800) ,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Huntington Beach that it hereby approves the recommenda-
tion of the Public Works Director and authorizes said public
works project and purchases to be made by the contractor, La
Cuesta, and the City Council deems such project to be an urgent
necessity for the preservation of life, health or property .

vote of more than a majority of all the members of said City Council
