HomeMy WebLinkAboutCity Council - 4514 RESOLUTION NO. 4514 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ORDERING THE VACATION OF A PORTION OF ENGINEER DRIVE WHEREAS, on August 1, 1977, the City Council of the City of Huntington Beach duly adopted Resolution No. 4499 declaring its intention to vacate a portion of Engineer Drive, and referring to maps or plans on file in the office of the City Clerk for particulars as to the proposed vacation; and Said resolution fixed the time and place of September 6, 1977, at the hour of 7: 30 p.m. , or as soon thereafter as the matter may be heard, in the Council Chambers in the Civic Center, Huntington Beach, California, for hearing all persons interested in or objecting to the proposed vacation, which time was not less than fifteen (15) days from the passage of said resolution. Notices of the proposed vacation were posted conspicuously along said portion of Engineer Drive, and such notices were posted not more than three hundred (300) feet apart and at least three (3) were posted. On September 6, 1977, at the hour of 7: 30 p.m. , thereof in the Council Chambers in the Civic Center, Huntington Beach, California, the City Council of the City of Huntington Beach did convene for the purpose of hearing all persons interested in or objecting to the proposed vacation of a portion of Engineer Drive, at which time no objection was made to said vacation, and evidence was presented showing that the said portion of Engineer Drive proposed to be vacated is not necessary for present and prospective public street purposes or is not suitable for use or development as bicycle paths or routes . NOW, THEREFORE, the City Council of the City of Huntington Beach, pursuant to Division 9 , Page 3, Chapter 2 of the State i MT: c.s 1. f o California Streets and Highways Code (Sections 8320 et seq. ) , does resolve that that portion of Engineer Drive hereinafter set forth is not necessary for present or prospective public purposes , and is not suitable for use or development as bicycle paths or routes, and it is hereby ORDERED that the following-described portion of Engineer Drive be and the same is hereby vacated; and said portion of Engineer Drive so vacated is described as follows: In the City of Huntington Beach, County of Orange, State of California; those portions of Engineer Drive, as shown on a map of Tract No. 8694, recorded in Book 401, pages 45 to 48, inclusive, of Miscellaneous Maps and Records of said County, more specifically described as follows : Parcel No. 1: Beginning at a point on the southerly line of Lot 1 of said tract , said point being a point on a curve concave northerly and having a radius of 59 .50 feet, and distant thereon 13. 70 feet westerly, measured along said curve from its easterly terminus; a radial to said point bears south 12145' 08" west; thence westerly along said curve and the south line of said Lot 1, through a central angle of 21145' 08" an arc length of 22. 59 feet to a point of reverse curve with a curve concave southerly and having a radius of 40. 50 feet ; a radial to last said point bears south 34034111" west; thence along last said curve and the south line of said Lot 1 through a central angle of 64004, 04" an arc length of 45. 29 feet to an intersection with a curve concave northerly and having a radius of 377.50 feet ; a radial to last said point bears north 29029 '53" west; a radial from the radius point of said 377 . 50 foot radius curve bears south 14029 ' 31"west; thence leaving the south line of said Lot 1, easterly along said 377.50 foot radius curve through a central angle of 9°47120" an arc length of. 64. 50 feet to a point to which a radial bears south 4052111" west and the Point of Beginning. Parcel No. 2: Beginning at a point on the north line of Lot 46 of said tract , said point being the westerly 2. terminus of that certain curve shown as having a central angle of 90000100" and a radius of 29 . 50 feet;.-thence along the north line of said Lot 46, south 89039116" west 20. 76 feet to the beginning of a tangent curve concave southerly and having a radius of 59 .50 feet ; thence along last said curve and the north line of said Lot 46 through a central angle of 34054 '55" an arc length of 36.26 feet to a point of reverse curve with a curve concave northerly and having a radius of 40. 50 feet; a radial to last said point bears north 35015139" west ; thence along last said curve and the north line of said Lot 46 through a central angle of 116053' 08" an arc length of 82.62 feet to an intersection with a curve concave northerly and having a radius of 422 . 50 feet; a radial to last said point bears south 81037 '�9" west; a radial from the radius point of said 422 . 50 feet radius curve bears south 15053' 13" west; thence leaving the north line of said Lot 46 , easterly along last said curve through a central angle of 16013' 57" an arc length of 119. 70 feet to the Point of Beginning. The City hereby reserves and excepts from the vacation a permanent easement and right at any time or from time to time, to construct , maintain, operate, replace, remove and renew storm drains and appurtenant structures in, upon, over and across such street or any portion thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise to construct, maintain, operate, replace, remove, renew and enlarge free from inflammable materials and wood growth and otherwise protect same from all hazards in, upon and over said portion of Engineer Drive proposed to be vacated.
